일본의 인공지능에 대한 법적 대응 연구

국문 초록

인공지능의 기술발전과 함께 관련 법적인 대응도 필요한 시기이다. 일본에서도 세계의 인공지능 기술과 법적인 동향과 같이 빠른 변화를 진행해 왔다. 이미 2016년 관민데이터활용추진기본법에서 인공지능 관련 기술에 관한 개념을 정의하고 연구개발을 위한 조치를 할 수 있도록 규정했다. 2015년부터 일본도 세계에서 논의되고 있는 AI 윤리 정립에 보조를 맞추어 2018년 내각에서 ｢인간중심 AI사회 원칙｣을 도출했다. 다만 세계가 추진하고 있는 AI 원칙에 대하여 일본에서는 종래 개인정보 보호 관리 시스템에 의한 관시 시스템과 같이 형식적이고 유명무실한 것으로 취급될 우려가 제기되기도 했다. 결국, 2018년부터는 민법에서의 계약에서 AI를 활용한 계약에 대한 경제산업성의 “AI 데이터의 이용에 관한 계약 가이드라인”이 책정되어 그 개정 버전이 해마다 검토되고 있다. 2018년에 저작권법도 AI 사업자에게 유리하도록 인공지능에 의한 정보분석에 의한 저작물의 기록 또는 번안이 가능하도록 했다. 2019년에는 일본 개정 부정경쟁방지법을 시행하여 ID · 암호 등의 전자적 방법으로 관리하면서 상대방을 제한하여 제공하는 데이터(한정데이터)를 부정하게 취득 등을 하는 경우를 부정경쟁에 포함하도록 했다. 기타 2019년에 산업표준화법을 개정하고 전기용품안전법과 소비생활용제품안전법을 개정하여 인공지능의 법적 취급과 첨단기술에 대한 특례가 실시되었다. 이처럼 일본에서 인공지능에 대한 법적 대응은 AI 윤리와 정책적 대응을 넘어 구체적인 법적 제도 변화에 이르고 있다. 아직 관련 법적 제도 변경의 검토만 진행하고 있는 대한민국에서도 일본의 이러한 구체적인 개별법의 개정 변화에 대하여 참고하고 연구해 볼 필요가 있다.

영문 초록

Along with the technological development of artificial intelligence, related laws also become to be necessary. Japan has also undergone rapid changes, such as artificial intelligence technology and legal trends in the world. In 2016, ‘Framework Act on Promotion of Public-Private Data Utilization’ already stipulated necessary measures for the dissemination of concepts, R&D, and results related to artificial intelligencerelated technologies. Since 2015, Japan has also drawn up the principle of humancentered AI society and in 2018 Japanese Cabinet made up the establishment of AI ethics. However, concerns have been raised that the AI principles promoted will be treated as formal and cursory like the management system based on the personal information protection. After all, from 2018, Japanese Ministry of Economy, Trade and Industry made “Contract Guidelines on the Use of AI Data” for contracts using AI in contracts under the Civil Act was formulated, and the amended versions have been updated every year. In 2018, the Japanese Copyright Act also made it possible to record or adapt works by information analysis and artificial intelligence for the benefit AI operators. In 2019, the Japanese Amended ‘Unfair Competition Prevention Act’ was enacted to include unfair competition of illegally acquiring data (limited data) provided by restricting while managing electronic methods such as IDs and passwords. Others In 2019, ‘Industrial Standardization Act’ was amended and ‘Electrical Appliances Safety Act’ and ‘Consumer Product Safety Act’ were amended so that artificial intelligence can be legally treated. As such, legal responses to AI of Japan go beyond AI ethics and policy responses, leading to specific legal system changes. Considering that Japan is amending specific laws considering artificial intelligence, South Korea also needs specific research and attempts on the enactment and amendment of laws as well as general laws on artificial intelligence.
