국문 초록

디지털 시대에 들어서, 데이터는 이미 국가의 기초적 전략 구성으로, 데이터 안전이 없는 한 국가 안전은 보장될 수 없다. 중국의 경우, 핀테크 산업의 빠른 육성으로 개인정보와 기업정보의 양이 날로 확대되고 있다. 데이터의 경제 가치를 인식한 중국 정부는 오래전부터 중국 貴陽에 빅데이터 거래소를 설립하여 데이터 거래 시장의 육성을 추진하여 왔으나, 상위법의 미비로 큰 효과를 얻지 못하고 있는 실정이다. 이러한 상황에서 2021년에 제정한 ｢데이터 안전법｣은 데이터 거래를 위한 기초적인 법으로 작용될 예정이다. 데이터 관리에 대하여 ｢데이터 안전법｣에서는 유형별 관리제도를 도이하여, 데이터의 특징에 따라 상이한 보호기준을 제시하였고, 데이터의 경제적 가치에 기초한 데이터 거래 시장을 육성하는 의도 하에 데이터 안전 기준체계를 수립하여 데이터 거래에 대한 법적 기초를 마련하였다. 이러한 특징에 기초하여 ｢데이터 안전법｣에서는 政務 데이터의 안전과 개방에 관한 내용으로 정부 서비스 제공의 효율성을 향상하였고, 기업 컴프라이언스 의무의 강화로 기업내부의 데이터 안전을 강화하였으며, 해외 데이터 거래의 제한으로 데이터의 다국적 유통을 통제하였다.

영문 초록

In the digital age, data is a basic strategic construction of the country, and national safety cannot be guaranteed unless there is data safety. In the case of China, the scale of personal and corporate information is expanding due to the rapid development of the fin-tech industry. Recognizing the economic value of data, the Chinese government has established a big data exchange in China to foster the data transaction market, but it has not gained much effect due to the lack of legislation. In this situation, the Data Security Act enacted in 2021 will serve as a basic law for data transaction. As a characteristic of China's Data Security Act, the classification data protection rule was introduced to present different protection standards for each type of data. In addition, based on the economic value of data, the legal intention to foster the data transaction market through data transaction. Besides of this, establish a data security standard system to provide institutional preparation for the standardization of data transaction. Based on these characteristics, China's Data Security Act consists of three important contents. Firstly, stipulated the security and openness of government affairs data to promote the efficiency of government governance. Secondly, strengthen the internal compliance system of the enterprise. Thirdly, restrict overseas data transactions.
