소년분류심사원의 현황과 제도적 개선방안

국문 초록

소년범이 장래에 성인이 되어 범죄를 저지를 가능성을 제거하는 것은 소년형사사법의 핵심 목적이다. 이러한 측면에서 소년분류심사제도는 비행소년의 비행원인을조기에 진단하고 비행성을 제거하는 데 보다 큰 형사사법적 의의가 있다. 소년비행의 비행원인의 제거를 위해 무엇보다도 다른 기관에서 할 수 없는 전문적이고 효과적인 진단이 요구된다. 분류심사의 전문화를 위해서는 전문인력을 확보하고 업무환경을 개선하여 분류심사관이 소년분류심사에 있어서 업무적 부담으로 인하여 비행진단과 분류심사서 작성에 소홀할 가능성을 배제해야 할 것이다. 또한 위탁소년의 다양한 이전 경험 등을 고려하여 차별화되고 전문화된 교육프로그램의 개발도 필요하다. 그리고 분류심사원이 비행진단을 위한 최소한의 수용과 인권침해의 최소화를 위해 위탁기간 연장시 그 기준을 법률에 구체화하고, 연장이 필요한 경우 법적 근거를법률에 명시할 필요성이 있다. 그리고 위탁소년의 처분에 대해 이의제기 통로를 마련하여 분류심사에 대한 이의제기 절차규정도 논의해 볼 수 있다. 그러나 무엇보다도 중요한 것이 소년분류심사원에 관련기관 뿐 아니라 전 국민이비행소년의 장래에 대해 관심을 가지고 제도 운영시 발생하는 문제에 대해 적극적인문제제기와 관심이 더 우선시 되어야 할 것이다. 또한 소년범이 성인범으로 전이되어 우리사회가 감당해야 될 사회적 비용을 줄이고, 비행소년의 올바른 성장을 위한교정목적을 달성하기 위해 관련기관들이 경제적 논리에 따라 시설이나 인력의 증감을 반복하지 않고 우리사회의 안전을 위한 기관으로서 노력을 경주해야 할 것이다.

영문 초록

The purpose of modern criminal policy is prevention of crime, maintenance of social order, relief of victims of crime, retraining of criminals, re-socialization, return to society. In order to strengthen the role of the Juvenile Classification Review Center it is necessary not only to establish more the Juvenile Classification Review Center by the unit of metropolitan city but also to make small the current facilities of the classification review board and to abolish the classification review function of the proxy juvenile detention institutions. Considering negative side effects, classification review of young juveniles through detention should be limited as much as possible. Behavior observation and environment inspection should be the priority for the purpose of specializing classification review. And there is a need to remove transport of delinquents and night duty from the duty list of classification review officers to improve their work environment. They should be given ample office hours to diagnose misconducts and prepare classification review reports. There is also a need to develop specialized education programs to prevent delinquency especially those detained at the institutions in their beginning stage of delinquency. Regarding legislative improvements, there is a need for special budgeting and treatment of those subject to classification review through a separate legislation. In addition, for a specialized misconduct diagnose, the minimum number of juvenile delinquents should be detained. To minimize human rights violations, the criteria to extend detention period should be stipulated in related laws, and legal grounds should be prepared to more strictly apply the causes for detention.
