메타버스에서의 형법의 역할

국문 초록

시대의 변화가 너무도 빠르다. 하나의 과학･정보통신기술에 익숙해지기도 전에 차세대 기술이 문턱을 넘어선다. 그런 기술들이 종합적으로 합쳐지고, 현실 공간과 융합하여 만들어진 세계가 바로 메타버스이다. 과학･정보통신기술이 집약된 메타버스는 살아있는 생명체와 같다. 해당 기술들이 발달할수록 메타버스도 함께 변화해 간다. 성서에서도 태초에 죄가 세상에 들어온 것처럼 메타버스 속에서도 다양한 범죄 유형이 생겨나고 있다. 이제까지 범죄를 예방하고 진압하는 역할을 수행한 것은 형법이다. 그러나 새로운 시대에서 형법은 조금씩 그 역할을 여러 전문법 체계에 내어주며 상대적으로 역할이 축소되고 있다. 물론 전문법 체계에도 형벌 규정이 있고, 형벌 규정은 당연히 형법 체계에서 해석･적용되므로 형법의 역할이 축소되지 않는다고 볼 수도 있다. 형식적으로는 맞다. 그러나 실질적으로 전문법 영역에서 형법은 더 이상 체계적인 우위성이나 우선성을 주장할 수 없으며, 범죄에 대한 주도자의 역할이 아니라 보조자의 역할에 한정될 수 있다. 본 연구에서는 현실 공간과 사이버공간이 융합되는 메타버스에서 형법이 주도적인 역할을 할 수 있는 범죄 유형들과 전문법 영역에 역할 분담을 해야 할 유형들을 나누어 보았다. 그에 따라 ①메타버스 체계 자체를 위협하는 범죄, ②메타버스를 범죄 공간으로 이용하는 범죄, ③메타버스 내 구성 요소를 대상으로 이루어지는 범죄, ④메타버스 내 행위가 현실 공간에 물리적인 영향을 미치는 범죄로 구분하였다. 그리고 ①번 유형은 전적으로 개별법 영역에서 다루고, ②번 유형은 형법 영역에 편입하며, ③번 유형은 개별법 영역과 형법 영역이 서로 분담을 하고, ④번 유형은 형법 이론의 발전과 새로운 범죄화에 대한 논의가 요구된다고 보았다. 하지만 이는 잠정적인 방법이다. 역사적으로 구축되어 온 형법의 독자적 역할을 유지하기 위해서는 형법전 외에 “메타버스 형법(또는 ‘사이버 형법’)”이라는 통합적 법률이 필요하다. 해당 법률은 전문법 영역에 산재되어 존재하는 범죄 유형들과 세계적으로 논의되고 있는 내용을 참조한 범죄 유형들을 체계적으로 종합하여 규정하여야 한다. 그를 통해 해당 법률은 실질적으로는 메타버스 범죄(또는 사이버범죄)의 가장 기본이 되는 기본법 역할을 수행할 필요성이 있다. 이제는 해당 작업을 더이상 미룰 수 없다. 이제부터 국회와 정부, 학계, 실무계 등이 법률 체계 정비와 관련된 논의를 통해 새로운 일상영역을 규율할 수 있는 메타버스 형법 체계를 구축해 나아가야 할 것이다.

영문 초록

Times are changing rapidly. Before you get used to one information and com- munication technology, you will encounter the next generation of information and communication technology. The world created by combining such technologies and converging them with real space is a metaverse. Metabuses, which are concentrated information and communication technologies, are like living creatures. As information and communication technology develops, metaverse also develops. However, just as sin entered the world in the beginning in the Bible, various types of crimes are emerging in metaverse. It is the criminal law that has played a role in preventing and suppressing crime so far. However, in the information age, the criminal law gradually gives its role to various specialized laws, and the role is relatively reduced. Of course, it can be seen that the role of the criminal law is not reduced because there are penal provisions in the area of specialized law. That statement is correct in form. However, in practice, in the area of specialized law, criminal law can no longer claim systematic superiority or priority. Criminal law plays an auxiliary role, not a leading role in crime. In this study, the types of crimes that criminal law can play a leading role in metaverse and the types that should be divided into specialized laws were distinguished. And it came to the conclusion that some of the crimes prescribed in the special law should be transferred to the criminal code. But this is a tentative way. In order to maintain the role of criminal law that has been historically established, integrated laws such as “metaverse criminal law” are needed. Therefore, it is necessary to systematically respond to cyber crimes scattered in the current specialized law area. The Metaverse Criminal Law is a special criminal law in form, but in practice, it will be a basic law for cybercrime. The work can no longer be delayed. From now on, the National Assembly, the government, academia, and working circles should have fierce discussions to establish a “meraverse criminal law system” that fits the new era.
