국문 초록
윌리엄 셰익스피어의 베니스의 상인은 세계문학사에 영원히 기록될 두 명의 흥미로운 인물을 창조했다. 유대 고리대금업자 ‘샤일록’과 기독교 귀족 여성 ‘포셔’ 가 그들이다. 법적 정의를 요구하는 샤일록과 자비의 필요성을 역설하면서도 법의 심판을 강행하는 포셔는 그들이 각기 대변하는 성적․종교적․인종적․계급적 차이와 함께 선명한 대조를 이루고 있다. 근대 전환기 베니스의 법정에서 두 사람이 벌이는 세기의 대결은 포셔의 현실적 승리로 귀결된다. 그러나 그녀의 판결이 남긴 여진은 어느 한쪽의 일방적 우위를 통해 해소할 수 없는 복잡한 문제를 안고 있다.
샤일록과 포셔가 각기 주장하는 ‘정의’와 ‘자비’는 유대교와 기독교의 대결을 함축할 뿐 아니라 두 범주 사이의 관계설정은 윤리학의 오랜 숙제이기도 하다. 셰익스피어는 이 윤리적 난제에 보통법과 형평법이라는 근대 영국법을 가져온다. 법적 관점에서 볼 때 베니스의 상인은 보통법에 대한 형평법의 승리를 함축하고 있으며, 윤리적 관점에서는 정의에 대한 자비의 우월성을 인정하는 것으로 보인다. 그러나 보통법과 결합된 샤일록의 정의나 형평법과 결합된 포셔의 자비는 각기 도착적 측면을 노정한다. 1파운드의 살을 도려내겠다는 샤일록의 요구는 그가 기독교사회로 부터 받은 차별과 멸시를 되갚아주고 법 앞에서 동등한 개인으로 인정받겠다는 정당한 요구를 담고 있지만, 증서의 문자에 도착적으로 집착함으로써 결과적으로 정의를 훼손한다. 포셔는 과도한 정의를 완화시키는 도덕적 가치로 자비를 설파하지만, 그녀가 법정에서 보여주는 모습은 자비의 이름으로 자비를 탈취하는 인종차별 주의에 지나지 않는다. 본 논문은 결론에서 데리다와 니체의 입장을 변용하여 인간의 취약성을 인정하는 정의의 자기지양으로서 자비를 주장한다.
영문 초록
In The Merchant of Venice William Shakespeare created two interesting characters that will forever be recorded in the history of world literature.
They are Jewish usurer Shylock and Christian noble woman Portia. Shylock who demands legal justice, and Portia who argues for the need of mercy, are in clear contrast with each other. The confrontation between the two figures in the court of Venice seems to result in Portia’s victory. However, the after-shocks left by Portia’s verdict contain complex problems that cannot be solved by her one-sided victory. The “justice” and “mercy” that Shylock and Portia respectively claim imply a confrontation between Judaism and Christianity, and establishing a desirable relationship between the two has been a long-standing task of ethics. Shakespeare brings modern British law like common law and equity law to this ethical controversy. From a legal point of view, The Merchant of Venice implies the victory of equity over common law, and from an ethical point of view, the superiority of mercy on justice. However, Shylock’s insistence on justice with the common law and Portia pursuit of mercy with the equity law respectively reveal their perversive aspects. Shylock’s claim to cut out a pound of flesh contains a legitimate demands of paying back the discrimination and contempt he has suffered from Christian society and being recognized as an equal being before the law; however, it comes to undermine justice by overly sticking to the letter of the bond. Portia preaches mercy as a moral value mitigating excessive legal justice, but what she shows in the court scene is nothing other than anti-Semitic act that destroys mercy in the name of mercy. In the conclusion, this essay argues for mercy as a sublation of justice, revising Derrida’s and Nietzsche’s views and acknowledging vulnerability as a common condition of human beings.
