한국의 독도영유권에 대한 법사학적 쟁점과 식민지배

국문 초록

현재까지의 국내외 독도연구는 국제법 연구와 역사 연구로 대별되어 진행되었다. 법적 연구에 있어서는 독도의‘영유권’(sover-eignty, ownership, 영토주권)의 문제와 한일간 어업 및 배타적경제수역(EEZ) 경계획정 등의 주제 및 전문분야별 문제로 구별하여 진행되었다. 특히 독도영유권의 연구는‘본원적 권원’(original title) 또는‘역사적 권원’(historictitle)과‘실효성(지배)’(effectivities, effective control, effective occupation)등에 근거한‘현대적 권원’및‘권원의 행사 및 유지’등에 관한 분야별 연구가 수행되었다. 한편 역사적 연구는 연혁적으로 크게 1894년‘갑오개혁기’를 전후한 전근대 및 근대 등 시기적 구별에 기초하여 연구되었다. 이러한 법적 역사적 연구는 기본적으로 독도의‘고유 영토론’과 ‘무주지 선점론’으로 대별되어 법과 역사간의 학제적 기틀을 형성하고 있다. 이에 본고에서는 현재까지 독도영유권에 관한 한일간의 연구 경향을 개괄적으로 고찰하고, 한일간 법사학적ㆍ법제사적으로 주요 쟁점들을 추출 분석하고, 독도영유권 증거 자료, 대응평가 등에 관한 검토를 통해 향후 독도연구 과제와 전망을 제안한다.

영문 초록

Still, the researches within and outside of Korea on Dokdo has been proceeded by different aspect of present international law and history. In legal study, some specialized topics on Dokdo focusing‘ sovereignty’issue and fishery and deciding practical line of EEZ etc. was proceeded. Especially, study on Dokdo sovereignty was proceeded about‘Modern Original title’and‘Practice of the title and maintenance’etc. on the basis of treated about‘original title’,‘historic title, and‘effective occupation’as specialized area of works. On the other hand, the historic study was largely divided focusing on before and after 1894‘Gap-O Revolution Period’which distinguished modern or pre-modern period. This kind of legal and historic study have formed a two basic features of Dokdo research as‘inherent territory theory’and‘Terra Nullius’to construct interdisciplinary works between legal and historic study. This paper generally review the research trend on Dokdo sovereignty until present time and will extract major dispute issues between Korea and Japan to analyze them, and suggest a few prospect and tasks on the Dokdo sovereignty proof materials, evaluation for counter measure.
