국문 초록

과학기술의 발전은 생활의 모든 부분에 지속적으로 영향을 미치고 있다. 형사사법시스템의 영역도 과학기술의 영향을 받는 대상이다. 과학기술은 형사사법시스템에 변화를 요구하고 있고, 특히 원격영상장치의 활용은 형사절차에 편리함과 경제성을 가져다 줄 것으로 예상하였다. 그러나 기존의 원격영상시스템 활용의 현황을 살펴보면 그 기대에 부응하지 못하는 수준이다. 더욱이 코비드 19의 상황은 원격영상시스템의 활용이 더욱 활성화되어야 할 필요성을 제기하고 있다. 이를 위해 본 연구는 먼저 수사, 재판, 교정의 영역에서 영상장치의 활용현황과 법적/경제적 쟁점을 분석하였다. 분석의 결과에 근거하여 직접주의, 공판중심주의 및 적법절차원칙 등 형사법의 여러 원칙과 조화를 이루는 원격영상장치 활성화 방안으로 출석 등 관련 법적 개념의 정비, 명확한 법적 근거의 마련, 피고인의 신청 및 거부권 인정, 공판정 대면신문과 동일한 신문효과 제공을 위한 기술적 지원 등을 제시하였다.

영문 초록

The development of science and technology continues to affect all areas of life. The area of ​​the criminal justice system is also affected by science and technology. Science and technology are demanding changes to the criminal justice system, and in particular, the use of remote imaging equipment is expected to bring convenience and economic feasibility to criminal proceedings. However, looking at the current status of the use of the existing remote imaging equipment, it is at a level that does not meet the expectations. Moreover, the situation of Covid 19 raises the need to further activate the use of remote imaging devices. This research analyzed the current state of use of imaging devices and legal/economic issues in the areas of investigation, trial, and correction. Based on the results of the analysis, this study suggests activation methods for VC in harmony with trial-centeredness and due process principles as follows: rearrangement of legal concepts such as attendance, preparation of clear legal grounds, defendant s right to request/reject, and technical support providing interview as equivalent as face-to-face interview in courts.
