사립대학 구조개혁 법안의 쟁점과 개선방안

국문 초록

우리나라는 장기적인 저출산의 추세로 인하여 학령인구가 급감하는 추세이다. 최근 2020년부터 코로나19 펜데믹의 영향으로 외국인 유학생수도 감소해 대학의 경영위기는 가속화되고 있다. 교육부는 고등교육의 위기를 극복하기 위한 대학평가에 따른 등급 부여와 불이익 조치를 연계한 정책 등을 통하여 대학 구조개혁 정책을 지속적으로 추진해 왔다. 종전의 사립대학 구조개혁법안은 대학의 체계적인 구조조정을 촉진/지원하기 위해 법적 근거를 마련하고, 학교법인의 해산시 자발적인 퇴출을 유도한다는 긍정적인 평가가 있는 반면에, 사립대학 잔여재산 처분에 대한 특혜문제 및 면직되는 교직원에 대한 사회안전망 규정의 미비 등의 비판도 상존하고 있다. 이러한 상황에서 대학의 자율성과 배치되지 않는 방향에서 실질적으로 구체적인 내용을 담은 대학 구조개혁법안의 제정이 필요하다. 본고에서는 사립대학 구조개혁법안 중 노동법적 쟁점에 중점을 두어서 검토하였다. 그 개선방안으로 (ⅰ) 사립대학 학교법인 잔여재산 처분 개선방안으로 설립자의 기본금의 개념 명확화, (ⅱ) 교직원의 면직과 관련 근로기준법상 경영상해고 제한 규정을 신설, (ⅲ) 대학이 폐교·폐지시 교직원의 사회안전망으로 폐교대학 종합관리지원센터의 설치, 면직보상금 및 명예퇴직제도를 명확화, 고용안정사업 및 직업능력개발사업 예외규정 신설을 해야 한다. 모쪼록 향후 대학 구조개혁법안의 논의에 일조하기를 기대해본다.

영문 초록

In Korea, the school age population is rapidly decreasing due to long-term low birth rate. Recently, the number of foreign students studying abroad has decreased due to the influence of the coronavirus 19 pendemic since 2020, accelerating the management crisis at universities. The Ministry of Education has continued to push for university structural reform policies through policies that link disadvantage measures and grading according to university evaluation to overcome the crisis of higher education. While the previous private university structural reform bill establishes legal grounds for promoting/supporting systematic restructuring of universities and encourages voluntary eviction of school corporations, there are also criticisms such as preferential treatment and lack of social safety net regulations for dismissed faculty. Under these circumstances, it is necessary to enact a university structural reform bill that contains substantial details in a way that does not contradict the autonomy of universities. This high school focused on labor legal issues in the private university structural reform bill. As a way to improve the disposal of residual property at private university schools, the concept of foundation money should be clarified, the regulation on the dismissal of faculty members and the restriction of management dismissal under the Labor Standards Act should be established, the university should establish a comprehensive management support center, and the retirement system. We look forward to helping discussing future university structural reform bills.
