국문 초록

정치이론이나 법학 분야에서 많은 학자들은 오랜 기간 동안 공화주의를 연구해왔다. 하지만 그들이 공화주의에 대한 정의를 정식화한 경우는 거의 없었다. 그들의 연구는 주로 각자의 관점에서 공화주의의 특수한 특징들을 연구하는 데 초점을 맞추었다. 따라서 그들은 공화주의의 몇 가지 가치들, 특히 공동선, 공화주의적 자유, 혼합정체, 시민적 덕성에 초점을 맞추어 공화주의의 특수한 측면들을 연구했던 것이다. 이러한 학문적 상황은 불행하게도 공화주의에 대한 총체적이고 체계적인 연구에 장애가 되고 있다. 이 논문의 목적은 공화주의의 개념요소들을 확정하고 공화주의에 대한 정의를 정식화하는 것이다. 이러한 작업에 앞서 필자는 서양과 동양에서의 공화의 어원을 검토할 것이다. 공화라는 용어의 어원은 공화가 군주제의 폐지와 공동선의 추구를 함축한다는 것을 보여준다. 이것은 공화주의를 정의함에 있어서 하나의 실마리로서 중요한 역할을 담당한다. 공화주의에 관한 기존의 연구들에 대한 비판적 분석을 바탕으로 필자는 공화주의의 개념요소들을 다음과 같이 확정한다: 정치적 동물로서의 인간, 공동선, 자유, 자치, 법치, 시민적 덕성. 공화주의의 정의를 정식화하는 것은 공화주의의 개념요소들을 논리적으로 결합함으로써 가능하게 된다. 공화주의란 정치적 존재로서의 국민이 시민적 덕성을 발휘하여 자치를 실행해야 하는 정치공동체로서의 국가는 법치를 통하여 공동선에 봉사하고 국민의 자유를 보호하여야 한다는 원리를 말한다. 이 논문에서 제시된 공화주의에 대한 정의는 공화주의에 대한 이해를 증진시키는 데 도움을 주고 또 공화주의에 대한 체계적인 연구를 위한 기초를 제공할 것이다.

영문 초록

Many scholars have studied republicanism in the sphere of political theory and jurisprudence for a long time. However they scarcely formulated the definition of republicanism. Their studies mainly focused on examining particular features of republicanism in their respective perspectives. Therefore they studied certain aspects of republicanism in focus on certain values of republicanism, in particular the common good, republican liberty, mixed constitution, civic virtue. Unfortunately this academic situation is an obstacle to the total and systemic research of republicanism. The aim of this article is to identify the conceptual elements of republicanism and formulate the definition of republicanism. Prior to this main work, I examine the etymology of the term republic in the western and eastern world. The etymology of the term republic shows that republic implies the abolishment of monarchy and the pursuit of common good as the purpose of the state. These implications of republic play an important role as a clue in defining the concept of republicanism Based on the critical analysis of previous studies on republicanism I proceed to identify the conceptual elements of republicanism as follows: human being as a political animal, the common good, liberty, self-government, the rule of law, and civic virtue. The definitional formula of republicanism should be derived from the logical connection of the conceptual elements of republicanism. Republicanism can be defined as a doctrine that the state as a political community in which the people as a political being ought to practice self-government by exercising their civic virtue should realize the common good of its citizens and protect their liberty through the rule of law. Of course, this definitional formula of republicanism presented in this article may not be perfect. It must be complemented by further study. It may be expected to help promote the scientific understanding of republicanism and provide academic foundations for more profound and systemic study of republicanism.
