장애인고용법 시행 20년의 평가와 개선방안

국문 초록

본 연구는 「장애인고용촉진 및 직업재활법」이 변화 속에서 의도한 목적이 효과적으로 실현되었는가를 장애인 고용보호가 본격적으로 시작된 지 20년이 되는 현시점에서 평가하는 내용을 갖는다. 그리고 이를 토대로 문제점에 대한 개선방안을 제시함으로써 관련 제도들이 보다 안정적이고 실효성 있게 뿌리내리도록 하는 데 목적이 있다. 이 법은 고용의무제도와 고용부담금제도, 그리고 고용 장려금제도를 주요 축으로 한다. 분석결과 법 제정 이후 지난 20년간 변화하는 정책 환경에 대응하기 위해 여러 차례의 개정이 있었다. 그 결과 시행 초기인 1991년 0.43%이던 장애인고용률이 2010년에 2.24%로 5배 이상 증가하였으며, 10,462명이던 장애인근로자는 126,416명으로 12배 이상 많아지는 등 단기간에 상당한 수준의 고용성과도 있었다. 그러나 고용의무 대상기업의 확대와 의무고용률의 상향에도 불구하고 장애인 일자리는 한계에 봉착해 있고, 그나마 고용의무 제도를 통해 마련된 일자리는 대부분 경증장애인이 차지하고 있어 보다 더 보호가 필요한 중증장애인은 노동시장에서 소외되는 문제가 발생하고 있었다. 또한, 기업은 고용의무를 이행하기보다 고용부담금의 납부를 선호하고 있었다. 이러한 문제를 해결하기 위해 의무고용률 상향조정, 공공부문의 선도적 역할 강화, 부담금의 차등 부과, 의무규정 위반에 대한 제재 도입, 고용부담금의 유도･조정적 기능 강화, 정부부문의 부담금 부과, 고용장려금의 사중손실 방지 및 지급대상 조정 등의 개선방안을 제시하였다.

영문 초록

The government s ultimate goal in the policy for the disabled is to build an inclusive society for the disabled, and in this regard, the employment of the disabled are considered very important. The Korean government s policy for employment of disabled hit its stride when the Employment Promotion, Etc of Disabled Persons Act (the Old Act ) was enacted and became effective. The Old Act mainly relates to an obligation to employ the disabled, a contributory charge for employment of the disabled, and incentives for the employment of the disabled. The obligation to employ imposes a certain obligation to employ the disabled to the government and to private companies, to a certain extent. In case of failing to fulfill the obligation, the government will impose a contributory charge for the employment of the disabled but on the other hand, in cases where a company hires the disabled exceeding the number required by the act, the government will give incentives to the company. The Old Act was completely revised, and enacted in 2000 under a new name, The Act on Employment Promotion and Vocational Rehabilitation for People with Disabilities (the “New Act”). For the last 20 years, there have been many amendments to the New Act in order to increase its effectiveness, and it is hard to deny that the system mandating employment of the disabled made a great contribution to the expanded employment of the disabled. But, the government continuously receives demands for better solutions in connection with the policy to encourage employment of the disabled, having many circumstantial changes including recent increase in types of disabilities and expansion of scope of disability, diversified policy demands due to the rapidly increased number of the disabled, and the enactment of the Act on the Prohibition of Discrimination of People with Disabilities. In particular, since the number of disabled people is sharply increasing, the most imminent and crucial problem shall be that the number of job opportunities appears to reach the limits and the percentage of the employment opportunities taken by the severely disabled based on the obligation to employ the disabled is declining. Therefore,this thesis is to build a stable and effective system by closely looking at the status of the current system imposing a contributory charge and offering incentives for employment of the disabled and by suggesting possible changes thereof.
