NPO 활성화를 위한 노동법적 방안 검토

국문 초록

우리나라는 2000년에 비영리민간단체 지원법을 제정하여 일정한 요건을 갖춘 NPO에게 보조금 등의 재정지원을 하고 있다. 법 시행 후 20년이 지난 지금 NPO의 수가 증가하였고 그 활동 분야도 상당히 넓어졌지만, 미국, 일본 등 다른 나라와 비교하면 NPO가 충분할 정도로 활성화되었다고 보기는 힘들다. 사회복지 분야에서 아직까지 국가의 재정이나 행정력이 미치지 못하는 부분이 많아 NPO의 활발한 활동이 필요하고, 고령자나 전업주부 등 취업 취약계층의 사회적·경제적 활동을 촉진하기 위해서는 앞으로 NPO를 더욱 활성화시킬 필요가 있다. 법적 관점에서 NPO를 활성화하기 위한 방법은 여러 가지가 있을 수 있다. 그런데 NPO 활동의 대부분은 NPO에서 활동하는 자원봉사자에 의해 이루어지고, 그 방식은 주로 노무를 제공하는 방식으로 이루어진다는 것을 고려하면 이들에 대한 노동법적 보호는 효과적인 활성화 방안이 될 수 있다. 단기적으로는 NPO에서 활동하는 자원봉사자들에게 최저 수준 이상의 보상을 하는 방안과 자원봉사자들에게 산재보험 등 사회보험을 적용하는 방안을 고려할 수 있다. 기존 자원봉사활동의 ‘무보수성’에서 벗어나 자원봉사자에게 일정 수준 이상의 보상을 한다면 더 많은 사람들이 자원봉사에 참여하게 할 수 있고, 사회보험을 통하여 자원봉사자들에게 여러 위험으로부터 보호할 경우, 보다 안정적으로 자원봉사활동을 지속할 수 있을 것이다. 장기적으로는 앞으로 AI나 로봇 등에 의해 일자리가 많이 줄어든다는 점을 고려하여 기존의 ‘노동’의 개념에 ‘공익활동’을 포함하여 노동의 범위를 확장하는 것을 고려할 수 있다. 그리고 기본소득과 관련하여 공익활동 참여를 기본소득의 지급요건으로 하는 ‘참여소득’형태의 기본소득도 고려할 수 있다.

영문 초록

Korea enacted the Assistance for Non-Profit Organization Act in 2000 and the government provides financial support, such as subsidies, to NPO that meet certain requirements. Twenty years after that law was enforced, although the number of NPO has increased, and the field of activity has expanded considerably, it is hard to say that NPO has been activated compared to other countries such as the United States and Japan. In the field of social welfare, there are still many areas that are not within the national financial or administrative power, so active activities of NPO are needed. And in order to promote the social and economic activities of the socially and economically vulnerable class, such as the elderly and full-time housewives, NPO need to be further activated in the future. There may be several ways to activate NPO from a legal standpoint. However, considering that most of the NPO activities are done by volunteers working at NPO, and the method is mainly by providing labor, labor legal protection for them can be an effective way to revitalize NPO. In the short term, the organization may consider offering compensation above the lowest level to volunteers working at NPO and applying social insurance, including disaster insurance, to volunteers. If volunteers are compensated beyond a certain level, they will be able to participate in volunteer work, and if they are protected from various risks through social insurance, they will be able to continue their volunteer work more reliably. From a long-term perspective, considering that jobs will be greatly reduced by AI or robots in the future, we can consider expanding the scope of labor, including “public interest activities,” in the existing concept of “labor.” In addition, basic income in the form of “participatory income” in which participation in public interest activities is a payment requirement for basic income may be considered.
