국문 초록

블루카본(blue carbon) 거래제도는 블루카본을 보존하는 경우, 양식장, 염전 등 다른 경제활동을 하지 못함으로써 받게 되는 손해, 즉 기후변화를 억제하는 기회비용을 국제사회가 지불하는 시스템이다. 기후변화협약 당사국 회의 등 다양한 국제협상에서 다방면의 논의를 거듭하며 블루카본 거래 제도를 체계화하고 있으며, 선진국들은 이미 블루 카본 시장을 선점하기 위해 활발한 투자를 하고 있다. 본 연구의 목적은 어촌마을단위 블루카본 거래를 위해 갯벌 주변 현지 주민에 대한 탄소권 설정과정에서 발생할 수 있는 입증책임 관련 법적 쟁점들을 사전에 점검하고 분석하는 데 있다. 블루카본 서식지를 기반으로 하는 블루카본 상쇄 사업이 해당 지역 주민들과 협의없이 진행되는 것은 현실적으로 불가능하다. 블루카본 서식지를 점유하고 있는 지역 주민들과 유대관계를 형성하고 협업구조를 마련하는데 장기간이 소요된다. 따라서 탄소거래 수익의 분배 등 행정절차법에서 제기되는 쟁점의 절차적 정당성을 확보하기 위해 어촌 마을에 전국단위로 존재하는 어촌계에 탄소권을 부여하여 어촌 마을 단위별로 블루카본 거래를 사업을 실시하는 방안이 실현 가능한 대안일 것으로 판단된다. 본 연구는 우리나라에서 블루카본 거래제도를 도입하는 과정에서 서식지를 점유하고 있는 당사자들에게 부여해야 하는 탄소권에 대해 이상과 현실의 괴리가 존재하지만 예측가능성과 집행가능성에 대한 근거자료를 제공한 점에서 의의가 있다.

영문 초록

Blue Carbon Trading is a system where the international community pays the opportunity cost for damage incurred by obstacles in conducting economic activities such as fish farms and salt evaporation pond to tackle climate change. Blue carbon trading system establishes its position as an official reduction mechanism on carbon dioxide by repeated discussions in various international negotiations such as the United Nations Framework Convention on Climate Change. Developed countries are already making active investments to preoccupy the blue carbon market. The purpose of this study is to analyze legal issues that may arise in the process of establishing carbon rights for local residents around the tidal flat for blue carbon transactions at a fishing village level. It is practically impossible to operate a blue carbon offset project, based on the blue carbon biomass habitat, without due consultation process with the local residents. It takes a long time to form a solid cooperative relationship to enter into a trading contract with local residents occupying the blue carbon habitat. Granting carbon rights to nationwide resident associations that traditionally exist in fishing villages could be a realistic alternative to conduct blue carbon transactions at individual fishing village units. This approach can secure procedural legitimacy raised in the administrative procedure, such as the distribution of profits earned from carbon transactions. The result of this study can be a valuable reference to handle legal issues raised in the process of introducing the blue carbon trading system in Korea, although there is a gap between ideals and reality about the carbon rights granted to those who occupy the habitat.
