특허보세구역제도 운영에 대한 관세분쟁사례 연구

국문 초록

한국의 특허보세구역은 외국물품을 관세부담이 유예된 상태로 보관, 제조ㆍ가공, 판매, 전시 그리고 건설을 수행할 수 있는 곳이다. 이러한 보세구역의 운영을 통해 수출입 물류의 원활화와 가공 무역의 진흥, 수출입 증대와 같은 효과를 기대할 수 있었다. 하지만 이러한 제도의 운영에 있어서 과세관청과 보세구역 운영인 사이의 관세분쟁이 빈번하게 일어나고 있다. 이러한 분쟁을 예방하고 보세구역제도의 개선을 위해서 본 연구에서는 최근의 조세심판원의 보세구역과 관련된 분쟁사례를 분석하였다. 이를 통해 보세공장, 보세판매장, 보세창고의 제도 발전을 위한 시사점을 제공하고자 하였다. 보세공장의 경우 역외가공제도의 개선과 원료과세 및 비례과세 제도의 절차적 보완이 필요하다. 보세판매장의 경우 국가 경제적인 측면에서 여행자 면세범위의 확대가 고려되어야 할 것이다. 보세창고의 경우 보세화물의 엄격한 관리를 위해 보세창고 운영인과 보세사에 대한 지속적인 교육과 심사가 필요해 보인다.

영문 초록

Korea s bonded area is where foreign goods can be stored, manufactured and processed, sold, exhibited and constructed with a tariff waiver. Through the operation of these bonded areas, we could expect such effects as smoothing of import and export logistics, promotion of processing trade and increase of import and export. However, in the operation of such a system, customs disputes between the Korea Customs Service and the operators of the bonded area are frequent. To prevent such disputes and improve the bonded area system, this study analyzed recent cases of disputes involving the bonded area of the tax tribunal. The purpose of this plan was to provide suggestions for the development of the system for bonded factories, bonded markets, and bonded warehouses. In the case of bonded factories, it is necessary to improve the offshore processing system and to make a procedural complement to the raw material taxation and proportional taxation system. In the case of bonded markets, the expansion of travelers tax-exempt range should be considered in terms of national economy. In the case of bonded warehouses, continuous education and screening of bonded warehouse operators and Bonded goods caretaker will be needed to ensure strict management of bonded cargo.
