국문 초록

본 논문에서 살펴본 SPS협정상 필요성 요건은 제2.2조의 필요성으로 조치의 필요성과 적용의 필요성을 요구하고 있다는 점을 살펴보았다. 또한 WTO에 공통적으로 적용되어온 WAB을 검토함으로서 필요성 테스트의 첫 번째 단계, 쟁점조치에 대한 개별적인 평가에만 관련이 있었다. 이러한 점을 고려하면 향후 SPS협정하에서 분쟁이 발생하는 경우 쟁점조치에 대한 정당성을 주장하는 피제소국은 그들의 조치와 적용에서 있어서 필요성을 확인해야 하고 이를 고려해야 한다는 것이다. 아직까지 SPS협정의 분쟁사례에서 필요성을 명확하게 다룬 판결은 없지만 최근에 한국과 일본의 분쟁에서 보았듯이 SPS협정 하의 분쟁이 증가하고 있다는 점에서 SPS조치의 필요성에 대한 요건을 논리적으로 정리함으로서 정책입안자에 도움이 될 것으로 판단된다.

영문 초록

It is important to note that the necessary requirements of the SPS Agreement as referred to in this paper require the necessary measure and necessary application for the necessity of Article 2.2. We have also looked at the WAB, which has been commonly applied to the WTO, and was only concerned with the first step in the need assessment and the individual assessment of the issue. In the event that a dispute arises under the SPS Agreement in the future, the respondent States that justify the issue action must identify and take into account the need for their action and application. Although there is no ruling yet to clarify the necessity of the SPS Agreement in the case of disputes in the SPS Agreement, as the recent disputes between Korea and Japan indicate that the dispute under the SPS Agreement is increasing. It would be helpful for policy makers to logically summarize the requirements for the need for SPS action by logically summarizing the requirements for the need for SPS measures.
