국문 초록

국제적으로 무역거래조건의 해석에 관한 통일규칙으로서 가장 널리 이용되고 있는 것이 Incoterms이다. Incoterms는 1936년 제정된 이후로 수차례 개정이 있었고, 2020년 1월 1일에 제8차 개정이 이루어져 현재 IncotermsⓇ2020이 시행중이다. IncotermsⓇ2020은 IncotermsⓇ2010과 비교할 때, 여러 가지 사항들이 개정되었지만 그 중에서도 특히 두드러지는 것은 Incoterms 규칙 내 조항의 순서변경, FCA상 본선적재표기 B/L에 대한 규정신설, CIP 조건에서 매도인의 최대부보의무 규정, DAT에서 DPU로 명칭의 변경 및 의무범위 확대 등 특징적인 사항 몇 가지를 꼽을 수 있다. 본 연구는 IncotermsⓇ2020의 개정사항들이 어떠한 주요지침을 설명하고 있는지 살펴보고, 그러한 개정사항을 실무에 적용했을 시 발생할 수 있는 문제점을 미리 제고·분석함으로써 그에 따른 시사점을 제시하고자 한다. 나아가 학계 및 실무계에서 개정 Incoterms를 사용하는데 따른 해석상의 오해를 줄이고, 이용상 도움을 주고자 하는 취지로 연구를 진행하였다.

영문 초록

Purpose : The purpose of this study is focused on the details of the major revision of the Incoterms 2020 which went into effect on 1 January 2020. In addition, the study also intended to help the academic circles and practice by analyzing potential problems to be encountered in advance and minimizing friction followed by the revision when the reviewed Incoterms are applied to the practice. Research design, data, methodology : This study mainly referred to the revised version of Incoterms 2020 published by ICC and official Korean translation of Incoterms 2020. In addition, this research was conducted on the basis of domestic papers and academic textbooks that studied the Incoterms. Results : The major revisions to the Incoterms 2020 include several things such as changes in the order of provision in the regulation of the Incoterms 2020, stipulation of the maximum obligation to insure under CIP conditions, and establishment of the B/L for the on board notation on the FCA. Conclusions : This study was intended to provide convenience and help the academic circles and practice by analyzing the issues caused in accordance with the major revisions in the Incoterms 2020 and suggesting implication for practical application to its users.
