통일독일의 행정통합 법제화에 관한 고찰

국문 초록

통일문제와 관련한 법제를 연구함에 있어서 독일의 통일과정을 검토･분석함으로써 얻을 수 있는 시사점은 많다고 할 수 있다. 그럼에도 불구하고 이를 통해 통일문제와 관련한 법제의 발전방향을 모색하는 노력이 부족한 실정이다. 이들 통일국가의 법제통합과 관련하여 남북의 통일문제와 관련한 법제의 방향을 모색하는 연구에 많은 관심을 두어야 할 것이다. 이러한 점에서 통일독일의 행정통합 법제화 과정을 고찰함은 한반도의 통일과정에 있어서 통일이후의 수많은 난제들을 미리 대비할 수 있을 것이라는 점에서 큰 의미가 있을 것이다. 한반도통일은 남북한 합의하에 평화적인 방법으로 추진되어야 하고, 무엇보다도 민족의 동질성 회복과 북한지역민의 차별과 소외됨이 없도록 통일이 이루어져야 한다. 이를 위해서는 여러 과제 중 통일과정에 대한 계획과 이에 대한 구체적인 법제화 방안의 준비가 필요하다. 또한 각 분야별 통합이 필요하고, 그 중에서도 행정통합의 법제화 방안의 준비가 핵심이 되어야 할 것이다. 이런 점에서 이상에서 고찰해 본 통일독일의 행정통합 법제화과정을 고찰함에 그 의미가 있다. 행정통합 법제화를 이루고자 하는 경우에 있어서 양 분단국 주민들의 감정에 가장 큰 주의를 기울여야만 한다. 그렇지 못한 경우에는 새로운 통일국가의 정체성 및 수용에 있어서 문제에 봉착할 가능성이 크다. 항상 염두에 두어야 할 것은, 두 분단국가의 통합에 있어서 법을 강압적으로 ‘관철’시켜서는 안 된다는 점이다. 1989년 독일이 통일되기 시작하는 과정에서 이러한 요소에 관한 적절한 고려가 이루어지지 않았으며, 이는 60년 또는 그 이상 분단을 경험한 국가의 통일이 이루어지는 경우에도 마찬가지로 매우 중요한 사안으로 작용하게 될 것이다. 통합에 있어서 법과 관련하여 통일된 법제도를 가지는 것은 지극히 형식적인 차원이며, 이보다는 사람들이 그것으로 인해 정체성을 발견함으로써 스스로 수용한 법제도를 통해 새로 통일된 국가를 자신들의 국가로 느끼는 것이 중요하다. 따라서 법제도 및 그 통합과 관련된 모든 방안들은 전체적으로 또는 부분적으로 그러한 측면에 초점이 맞춰져야 한다. 결국 한반도 통일과정에서는 행정통합 법제화의 이론과 계획이 통일국가의 지역에 적용･시행됨에 있어서 “현실 격리감”의 폭을 얼마나 줄일 수 있는가 하는 점이 핵심적 과제이다. 그리고 “지난 40년간 작업상 여러 자리를 거치면서 두 개의 분단국이 통일을 이루기 위해서 가장 빠른 방법은 단계별 과정을 거치는 것이라는 결론에 도달하였다”고 하는 Siegfried Broß 재판관의 견해에 동조하면서, 한반도통일 역시 점진적 통일방향에 맞추어 단계적･점진적인 행정통합 법제화를 계획･실행하여야 할 것이다.

영문 초록

It is obvious that unification of Korean peninsula should be proceeded with in a peaceful way under mutual consent, unified Korea should embody democracy and aim at welfare state. Above all, racial homogeneity should be recovered and integration should be done without discrimination and alienation for North Korean people. To do this, it would be essential to suggest blueprint about unification process and its concrete implementation plans. We can know through the case of unification of East and West Germany that administrative integration is a very important task. Consideration has to consider its meaning as the administrative integration of the unification process in Germany over legislation in this regard. Amount divided country to achieve in the case of administrative Integration legislation should take the greatest care to the residents of emotion. If not, if there is likely to run into problems in the new unified national identity and acceptance. Always be kept in mind, both in the divided country of forced Integration method to ‘impose’ a point that should not be. This did not occur in 1989 Germany was the proper consideration of these factors in the process of starting to unity, which will act as a very important issue, like in this case consisting of one unified experience for 60 years or more divided country. As a Unified law and the Legal System in relation to Integration is very formal level, it is important that people feel by finding their identity due to the newly unified country through the legal system in their own country by their own acceptance . Thus, all Plans related to the Legal System and its Integration should be focus in such a side in whole or in part. Eventually, the Legislative Plans for Administrative Integration is critical challenges to point how to reduce the width of discrimination of reality in the unification process of Korean Peninsula. And while tuning in. “Throughout the past 40 years, It is said that the fastest way to achieve for Unification in divided country is that passes through a step-by-step process.” by Siegfried Broß judge s view and agreee with that, gradual unification planning and gradual Administrative Integration enacted in accordance with the directions in Unification of Korean Peninsula.
