국문 초록

이 글은 재정분권(fiscal decentralization)의 개념에 대한 이해 부족으로 인해 파생되는 문제를 최소화하고자 시도된 것이다. 재정분권에 대한 가장 큰 오해는 중앙정부의 재원이 지방자치단체로 이양되는 것을 재정분권으로 간주한다는 것이다. 그 결과 재정여건이 열악한 지역이 오히려 재정분권을 더 강하게 요구하는 아이러니가 발생한다. 재정분권은 스스로의 책임 하에 재원을 확충하고, 재원을 재량적으로 활용할 수 있는 권한을 중앙정부로부터 지방자치단체로 이양하는 것을 의미한다. 얼핏 큰 차이가 없어 보이지만, 재원(financial resources)의 이양과 권한(authority and responsibility)의 이양 간에는 큰 차이가 있다. 국민조세부담을 고정시킨다면, 전자는 중앙정부가 세금을 거두어 지방자치단체에 나누어 주는 방식이기 때문에 사실상 재정집권에 해당되지만, 후자는 지방자치단체가 스스로 세금을 거두어 재원을 확보하는 방식이기 때문에 재정분권에 해당된다. 법정교부세율의 상향 조정을 재정분권으로 오해하는 것도 재정분권의 개념에 대한 오해에서 기인된다. 이 글은 지방소비세제도와 서울시 재산세공동과세 제도에 대한 이해를 통하여 재정분권에 대한 오해를 최소화하고자 작성되었다.

영문 초록

The paper attempts to clarify the concept of fiscal decentralization so that they could successfully proceed the decentralization policy. The fiscal decentralization focuses on the devolution of fiscal authority to the local government. In case of transferring the tax money from national government to local governments, it could be as the same as general revenue sharing among local governments. The property tax sharing system of Seoul shows that it targets to reduce the fiscal disparity among district governments in Seoul. In the view of benefited district government from the system, it could be misunderstood as a fiscal decentralization policy. In the same token, the newly introduced local consumption tax system might mislead the benefited local governments to regard the local consumption tax as a fiscal decentralization policy. Specifically, the modified local consumption tax lost the decentralization spirits in the process of legalization. Fiscal decentralization is related to the transfer of fiscal authority to the local governments, not to the transfer of financial resources to the local governments.
