자율주행자동차의 하자 또는 결함의 판단기준

국문 초록

자율주행자동차는 가까운 미래에 현행 법체계에 커다란 변화를 가져올 것으로 예상 된다. 자율주행자동차는 인간에게 안전성, 이동성, 효율성 등을 가져다주는 반면, 기술 자체뿐만 아니라 외부 환경과의 연결에 따른 사고의 잠재적 위험성에 대한 우려를 낳는다. 그 결과 자율주행자동차를 도입하는데 있어 가장 커다란 법적 문제는 자율주행 자동차가 사고를 내면 누가 책임을 질 것인지의 여부이다. 자율주행자동차가 상용화되면 기존의 책임법리만으로 새로운 현상을 완벽하게 규율할 수 없다. 자율주행자동차는 주행에 인간의 개입이 필요하지 않거나 최소화되어 있어 운전자 중심의 책임법리 변화가 불가피하다. 이 경우 민사상 책임법리를 운전자 중심의 책임체계에서 자율주행자동차를 제조한 제조업자 중심의 책임체계로 전환하여 자율주행자동차 사고에 대해서 제조물책임을 인정할 것인지의 여부가 문제된다. 그런데 제조물책임법에 따른 제조업자 책임은 제조물의 결함으로 인하여 발생한 손해에 한정 되므로 자율주행자동차가 사고를 낸 경우에 제조업자에게 그에 대한 책임을 묻기가 쉽지 않다. 이 연구는 책임법제의 근간으로 자리하고 있는 제조물책임을 중심으로 완전 자율주 행기능을 가진 자율주행자동차에 대해서 예상할 수 있는 결함 유형 및 판단기준을 검토하였다. 이와 함께 사용자의 자율주행자동차 오남용 및 제조업자의 개발도상의 위험과 같은 항변사유에 대해서도 검토하였다.

영문 초록

Autonomous vehicles are expected to make major changes in the current legal system in the near future. Self-driving cars increase the safety of road traffic, provide mobility to minors and the disabled, and increase the efficiency of road traffic by optimizing vehicle movements. On the other hand, autonomous vehicles raise concerns about the potential danger of accidents due to the increased connectivity of the network itself, virus infections and hacking. As a result, the biggest legal issue in introducing autonomous vehicles is who will be responsible for accidents that occur while the autonomous vehicle is driving in full autonomous driving mode. When autonomous vehicles are commercialized, existing responsibilities can t completely regulate new phenomena. Autonomous vehicles do not require or minimize human intervention in driving, so it is inevitable that driver-centered law changes. In this case, whether the civil law liability is shifted from the driver-driven responsibility system to the manufacturer-driven responsibility system that manufactures autonomous vehicles is a matter of whether to accept product liability for autonomous vehicles accidents. However, the liability of the manufacturer under the Product Liability Act is limited to damages caused by defects in the product. As a result, it is not easy for a manufacturer to provide a faulty autonomous driving capability to an autonomous vehicle, and if such a defect affects the overall structure according to specific technical conditions and causes an accident, the manufacturer is not responsible for it. This study examines the types of defects and criteria that can be expected for autonomous vehicles with full autonomous driving functions, focusing on product liabilities, which are the basis of Product Liability Act. We also reviewed the reasons for pleas such as misuse of autonomous vehicles by users and risks of developing manufacturers.
