국문 초록

다양한 데이터의 수집·이용은 자율주행자동차의 운행 및 기술개발과 불가분의 관계에 있다. 이들 데이터 중 많은 것들이 사람의 영상이나 위치 정보 등 개인정보에 해당 하여 개인정보를 보호하는 여러 법률상 적법한 수집·이용을 할 수 있는 근거가 필요하다. 자율주행자동차의 차량 위치정보는 다른 정보와 결합하여 차량 운행자를 식별할 수있다면 개인위치정보에 해당할 수 있다. 이러한 개인위치정보의 수집은 현행 법률에 따르면 정보주체의 동의에 의해서만 수집할 수 있다. 보행자의 개인위치정보 역시 마찬가지이다. 그러나 동적 정보라는 개인위치정보의 특성상, 그 정보가 축적된 기간과 양에 비례하여 정보의 민감도도 달라질 수 밖에 없다. 따라서 모든 개인위치정보를 일률적으로 취급할 것은 아니고, 정보의 양태에 따라 그 법적 보호에서도 차이를 둘 수있는 여지가 있을 것이다. 또한 정보주체와 정보관리자의 여러 이익을 형량하여 사전 동의 없이 개인위치정보를 수집할 수 있는 가능성을 열어두는 것이 합리적이다. 더불어 개인정보보호법, 위치정보법, 정보통신망법 등 여러 중복된 내용을 둔 법률들을 정리하여 수범자들이 규제 내용을 일목요연하게 파악할 수 있도록 함이 바람직할 것이다. 자율주행자동차의 운행을 위한 필수 정보의 수집은 보통 그 서비스를 이용하려는 이용자의 동의에 기반하여 수집되므로, 이용자의 형식적 동의가 있었는지가 문제의 핵심이 될 수 없다. 해외 동향을 살펴볼 때, 위와 같은 사안에서는 사이버 보안 등 이용 자의 정보를 안전하게 취급할 수 있는 기술적 설계가 중요하다는 인식이 있음을 알 수있다. 나아가 이러한 규범들은 가이드라인, 지침 등 연성법의 형태로 진행되고 있고 그러한 규범을 형성하는 과정에 다양한 주체와 전문가들이 참여하고 있음을 알 수 있다. 기술의 발전 속도와 과거에는 예상치 못한 새로운 문제들이 출현함을 감안할 때, 우리 역시 바람직한 기술 설계의 방향과 여러 법익간의 적절한 균형점을 찾는 과정에 다양한 주체들이 참여하고, 이를 기존 법률의 열린 공간에 담아낼 필요가 있다.

영문 초록

Collection and utilization of various data is inseparable from the operation and technology development of autonomous vehicles. Many of these data are personal information, such as a person s video or location information, and need a basis for legitimate collection and utilization of personal information under various laws protecting personal information. Vehicle location information of autonomous vehicles, combined with other information, may correspond to personal location information if the driver of the vehicle can be identified. The collection of such personal location information can only be obtained with the consent of current law. The same is true of pedestrians personal location information. However, considering the characteristics of personal location information as dynamic information, it is necessary to treat it differently in proportion to the accumulated period and amount. In addition, it is reasonable to leave open the possibility of collecting personal information or personal location information without prior consent by sentencing the various interests of the information subject and the information manager Furthermore, it would be desirable to reorganize laws with overlapping contents, so that people can get a clear picture of the regulations. When looking at overseas trends, technical design will be important to safely handle users information, such as cybersecurity. Given the pace of technological advancement and the emergence of new and unexpected problems in the past, we need to involve various actors in the process of finding the proper balance between the direction of desirable technology design and the various legal benefits, and to incorporate it into the open space of existing laws.
