특별예방을 위한 일부집행유예제도의 도입 가능성

국문 초록

집행유예는 단기자유형의 집행으로 인한 폐해를 방지함과 동시에 특별예방의 관점에서 범죄인의 원활한 사회복귀를 위하여 고안된 제도이다. 하지만 종전의 논의와 달리 최근에는 단기자유형이 반드시 부정적인 효과만을 초래하는 것은 아니라는 주장이 제기되고 있다. 뿐만 아니라 집행유예는 무죄라는 사회인식으로 인하여 국민들에게 법질서의 엄격함과 권위를 각인시키기에 미흡하다는 문제가 있으며 이러한 점들에 비추어 보아 형의 일부에 대한 집행유예를 인정해야 한다는 견해를 적지 않게 찾아볼 수 있다. 그렇지만 일부집행유예제도의 도입에 관하여 여전히 부정설이 우세하다고 할 수 있다. 2016년 일본에서는 형의 일부집행유예제도가 시행되었는데, 우리가 논의해왔던 내용과 다소 상이한 관점에서 검토가 이루어졌고, 목적도 달리하고 있어 주목할 만하다. 특별예방의 목적으로 도입된 일본의 동 제도는 상습성을 지닌 범죄자의 재범방지를 위한 효율적인 대처방안으로 각광받고 있다. 이에 우리나라와 동일한 대륙법계 국가이며 유사한 법체계를 지니고 있는 일본의 형의 일부집행유예제도에 관하여 검토하고, 시사점을 도출하고자 한다. 구체적으로 동 제도의 도입 경위, 목적 및 의의 등을 살펴보고 동 제도에 대해 평가하도록 하겠다. 그리고 이를 토대로 우리나라에 있어서 형의 일부집행유예제도의 도입가능성에 대해 논하고자 한다.

영문 초록

Suspended sentence refers to the system of suspending the execution of a sentence under certain conditions when there are extenuating circumstances, after pronouncing a sentence resulting from a judgment of a conviction, and making the sentence invalid when the period of suspension expires without any cancellation or annulment. This system was created to prevent harmful consequences of short term imprisonments, and simultaneously support criminals’ smooth rehabilitation to the society from a point of special prevention. Unlike previous demeanors, some now argue that short term imprisonments do not always cause negative effects. Systems in the United States such as shock parole after executing short term imprisonment, and shock probation after short term imprisonment prove this point well. In addition, many argue that suspended sentence is inefficient to imprint the rigour and authority of law and order from the point of general prevention and social awareness that views suspended sentence as being innocent, and that suspended sentence for partial sentences should be recognized. However, negative sentiments toward the introduction of partially suspended sentence are more predominant in Korea. Therefore, this study aims to review the system of partially suspended sentence in Japan, which is the Continental law country just like Korea and possesses similar legal systems. In other words, this study wishes to examine the details of introduction, purpose and significance of the system and deduct implications accordingly. Based on such, this study aims to discuss the possibility of introducing partially suspended sentence.
