헌법상(憲法上) 정보공개(情報公開)와 교육정보공시법(敎育情報公示法)의 입법방향(立法方向)

국문 초록

교육정보공시는 국민에게 다양한 교육에 관한 정보를 공개·공시하여 국민의 알권리, 학습권, 학부모의 교육권 등 헌법상 보장된 기본권을 보장하기 위한 것이며, 부수적으로 교육행정의 투명성과 효율성을 보장하기 위해 제도이다. 이미 공공기관의 정보공개에 관한 법률이 제정되어 학교, 교육행정기관 등 교육관련기관이 보유·관리하는 교육정보가 공개되고 있으나, 교육의 특수성을 살리기 위해 2007년에 `교육관련기관의 정보공개에 관한 특례법`이 제정되었다. 그러나 정보공시는 정보공개에 비해 규제를 강화하는 것이며, 이를 잘못 활용하는 경우 학교간 과잉경쟁을 유도하게 되고, 정확하고 최신의 정보가 적시에 공시되지 않을 경우 교육수요자에게 혼란을 가중시키는 결과를 초래할 수도 있다. 따라서 이와 같은 문제점 해결을 위해 `교육관련기관의 정보공개에 관한 특례법`과 향후 제정될 시행령(안)의 입법배경, 목적, 주요 내용을 분석해 보았는데, 현행 교육법체계와 상호 모순되는 점도 있으며, 공시항목과 공시대상기관, 공시시기에 있어 재고(再考)가 필요하다는 점을 지적하면서 향후 교육정보공시제도의 조기 안착을 위한 입법 방향을 제안하였다.

영문 초록

The Official Information disclosure is ensured to right to know which is based on the Constitution Law. And `the right to know` is based on the right to dignity of Human and right to education. Usually, the Official Information Disclosure is for the people`s right to know, but, the education records public announcement is for student and Parent`s right, such as right to know, right to learning, right to choice on school, and so on. The Education Records Announcement Act of 2007 is the special law of Official Information disclosure Act of 1996 and is scheduled to make an enforcement ordinance until 26. May. 2008. So, I review the background, purpose, and content about this Act and Ordinance, and examine the problem that is focused on the education legal system, list, content, period of education records announcement. First, it is more strictly regulate school administer because MEST(Minstry of Education and Science Technology), 16`s metropolitan&province education office have already made a guideline and it is more concrete than the public announcement act of 2007. Second, it is unreasonable what list and content are, when and how many times is announced. It needs to more flexible period, times, item, and so on. Third, the enforcement ordinance is enacted until 26, May, 2008, but it is not yet enacted. I think that it is violate of the law and fundamental right. Finally, I suggest the several legislative direction about this law and ordinance, and that is very useful of solving that problem.
