교육 부문 대안적 분쟁 해결 제도의 현황과 과제

국문 초록

교육 현장에서 갈등이 증가하고, 법적 분쟁으로 비화되는 경우도 많아지고 있다. 그러나, 재판은 법치국가에서 합리적 분쟁 해결 수단임에도 불구하고, 비용과 시간 등 여러 가지 면에서 문제를 안고 있다. 이런 배경에서 대안적 분쟁 해결 제도를 활용할 필요가 제기되는 바, 본 연구에서는 교육 부문 대안적 분쟁 해결 제도의 현황과 발전 과제를 제시하고 있다. 본 연구에서는 대안적 분쟁 해결 제도의 발생 배경 및 유형, 쟁점 등을 소개하고, 학교교육 분쟁조정위원회, 교원소청심사위원회, 사학분쟁조정위원회, 학교폭력대책자치위원회, 교원노동관계조정위원회, 학교안전공제보상심의회 등 기구의 설치 근거, 대상 분쟁, 설치 장소, 조정위원, 성격, 효력 등을 중심으로 현황을 개관하였다. 각 기구의 발전 과제를 제시하는 한편, 포괄적으로 교육 부문 대안적 분쟁 해결 제도를 발전시키기 위한 논의를 전개하였다.

영문 초록

In the process of the growth of conflict in education, justice has been widely used to settle the conflict. Although the justice is the most rational dispute resolution system in a law-governed country, people have difficulty in using the resolution system because it takes too much time and cost. There are also many other reasons that people don`t like use this system. Based on this background, many alternative dispute resolution systems have introduced in many fields. This paper is to introduce the six alternative dispute resolution institution in education and to inquire into the currents and prospects of these institutions. The currents of the six alternative dispute resolution institution are followed by the general introduction of alternative dispute resolution. The currents of the institutions are examined in terms of six points: the legal base of foundation of the institution, the subject of the resolution, the place to establish the institution, the committee man, the characteristic of the resolution and the legal validity of the resolution. Finally, the prospects of the six institution are discussed.
