사학분쟁조정위원회 법제화 과정에 대한 역사적 제도적 분석

국문 초록

본 연구는 사학분쟁조정위원회의 법제화 과정을 역사적 제도주의 관점에서 분석하여 정부의 의도와는 달리 임시이사제도 운영에 관한 사항을 다루는 기구로 법제화된 요인을 밝히는 것을 목적으로 하였으며, 분석결과 결론은 다음과 같다. 첫째, 정치권에서는 정부에서 추구한 사학분쟁의 공정하고 신속한 해결이라는 목적 보다는 관할청의 임시이사 선임의 자의성 배제라는 목적이 선행하였기 때문에 기능, 위원회 구성, 결정 사항의 효력에서 차이가 있었다. 둘째, 동 위원회를 심의 기구로 규정하면서, 심의결과에 대해서는 관할청이 따르도록 강제하는 불합리성을 포함한 채 법제화될 수 있었던 것은 비정상적인 입법절차로 인한 것이다. 마지막으로 현재의 자문기구 성격인 사학분쟁조정위원회를 명실상부한 사학분쟁조정기구로 역할 할 수 있도록 직무상 독립된 행정위원회로 확대·개편할 것을 제언한다.

영문 초록

The purpose of this study is to examine factors of difference between actually enacted Private School Dispute Resolution Committee which deals with temporary director and original intentions of government with the perspective of historical institutional analysis. The results of an analysis are as follows First, There were differences in fuction, line-up, effect of committee because politics circles give priorities on exclusion of concerned authorities which appoint arbitrary temporary director rather than the fair and rapid resolution of private school disputes Next, Private School Dispute Resolution Committee which is even advisory board has attributes such as the administrative commission because of abnormal legislative processes. Finally, I suggest that the current minister`s advisory board should be enlarged and modified into the administrative commission which is dependent in functions.
