교육복지에 관한 법리 및 관련 법제의 현황과 과제

국문 초록

오늘날 교육은 과거와는 또 다른 사회적 의미를 부여받고 있으며, 그것은 교육을 사회적 불평등의 심화내지 지속화라는 반(反) 복지적 현상이 나타나게 되는 주된 원인으로 봄과 아울러 이와 같은 현상을 극복할 수 있는 결정적 방안으로 보는 것이다. 즉, 교육과 복지의 문제는 더 이상 분리하여 고려할 수 있는 개념이 아닌 것으로 `교육복지`라는 개념이 이미 상당정도 정착되어 있다. 본 연구는 오늘날 그 필요성이 날로 증대되고 있는 교육복지에 대한 국가 정책의 안정적 수행을 위한 관계법령의 입법적 정비를 위한 기초 연구차원에서 수행되었다. 이를 위해 선행연구 및 관련문헌·정책자료 등을 토대로 교육복지의 정의 및 이념·원칙 그리고 법적 근거 등 법리적 내용을 살펴보았으며, 이와 함께 현행 법령들에 대한 종합적 검토를 통해 관련법제의 현황 및 문제점 분석을 수행한 후 향후 과제로 가칭 교육복지법의 제정방향에 대하여 검토하였다.

영문 초록

This paper tried to present the principles and tasks for the legislation of education welfare in Korea. It presented the status of legislation on the education welfare in Korea through examining the welfare related laws and developed the model for legislation. Although the concept of the education welfare is not clear, the education welfare state has been one of the important national educational policy directions. For example the United States of America has education welfare related laws, as follows, No Child Left Behind Act(2001), Title 1 of the Elementary And Secondary Education Act(1965), The 21st Century Community Learning Centers(1999), Adult Education Act, and The Individuals with Disabilities Education Act(1975). And France has also REP(Reseau d`Education prioritaire), IDS(Indice de difficulte sociale). And many countries have developed the education welfare related laws. Based on the concept of education welfare law, this paper established the model for developing the legislation for the education welfare law. It has some dimensions and each dimension has legislative tasks. The dimensions of the legislative model are as follows, First, the dimension of the basic framework for the educational welfare policy. It includes the policy directions for the education welfare policy and administrative system. The related laws with first dimension can be listed as follows, the Elementary and Secondary Education Act and the Framework Act on Education etc. Second, the dimension of guarantee of right of peoples to basic education. There are the Welfare of Disabled Persons Act as related law. Third, the dimension of solving the adaptation problem, for example the problem of returnee students. Fourth, the dimension of the solving the inequality problem in education. And lastly the dimension of the improvement of educational environment.
