건축법상 업무대행에 관한 제도개선 연구

국문 초록

본연구의 목적은 건축행정의 일부인 건축사에 의한 현장조사, 검사 및 확인업무 대행의 제도 개선을 위한 연구로, 운영실태를 분석하고 외국의 사례를 통해 제도의 발전 방향을 제시하고자 한다. 연구 방법은 건축법 및 건축조례를 통해 운영실태와 외국의 민간위탁 사례를 분석하였으며, 업무대행의 개념을 정리하고 제도의 도입배경부터 현재까지의 관련법령 변천과정을 정리하였다. 분석결과 업무대행자의 선정, 업무대행수수료의 산정, 건축허가 수수료 등에 대한 문제점을 찾아 제도의 발전방안을 제시하였다. 업무대행은 법적 한계에 따른 책임감 부족,수수료의 부담 등 법적, 실무적 한계를 가지고 있으므로 현재의 업무대행을 발전시켜 건축행정 업무를 민간에 위탁할 수 있도록 건축법을 개정할 필요성이 있으며, 이에 대한 연구가 진행되어야 할 것이다.

영문 초록

This study presents the field investigation by a qualified architect, examination, and the reform of verification agency system, which are the parts of the administration of construction. The objectives of this study are to analyze the operation condition and to suggest the direction of improvement based on the cases at home and overseas countries. The methods of the study include analyzing our operating conditions and similar cases of foreign countries by the building laws and building codes and redefining the concept of agency business and the transition process of the related statute from its introduction background to the current condition.Through the analysis, problems were found on the selection of business agencies, the charge of commission on conducting agency business, building permit fee, and so on, and the study suggests the development plan of the system. Agency business has a legal and operational limit of the lack of responsibility due to the legal parameters and the commission burden; therefore, it is necessary to revise the building code and conduct study continuously in order to contract out the administration of construction with the improved agency business system.
