현대국가의 지배적 헌정체제인 민주주의체제는 어떤 특정의 이데올로기에 의한 지배가 배제되고 다양한 이데올로기를 체제속으로 수용할 수 있어야 한다는 가치중립성과 다원성을 그 핵심으로 한다. 그런데, ‘포용(inclusion)’적 지배형태로
서 정치적 의사결정에 영향을 받는 모든 사람의 참여를 보장해야 한다는 민주주의는 현실적으로 시공간적, 기술적 제약으로 인해 효과적 민주주의의 운영을 위해 어느 정도의 ‘배제(exclusion)’가 불가피하게 된다는 모순을 내포한다.
이러한 민주주의체제의 포용과 배제의 긴장이 분명하게 나타난 사례가 바로 애국심을 드러내는 특정한 의식을 강조하면서 그러한 의식에 대한 비판과 반대를 정치적 공동체에서 ‘친구’와 ‘적’을 구분하는 중요한 기준으로 삼는 ‘충성선
서’제도라고 할 수 있다. 시대적 상황이 공동체의 통합을 강하게 요구할 경우 충성선서가 강조되었으며, 특히 미래공동체구성원의 교육담당자인 교사와 교수, 체제유지와 여론주도의 핵심계층인 변호사 등에 대해 정치적 충성선서가 강제되어
왔다.
충성선서에는 헌법과 법률을 지지 옹호할 것을 적극적으로 서약하는 선서(적극적 충성선서)와 정부를 배신하지 않을 것과 전복전 단체에 연루되지 않았음을밝히는 선서(소극적 충성선서)로 구분할 수 있고, 특히 후자는 단체의 불법목적에 대한 구체적 고의가 없는 자에게 확대됨으로써 연좌제로 작용해왔다.
국내외에서 특정 대상에게 요구된 충성선서, 즉 공무원의 임용조건으로 요구되는 충성선서, 연방법의 보호를 받기 위한 조건으로 노동조합간부에게 요구된 충성선서, 귀화조건으로 요구되는 귀화인에 대한 충성선서, 2차 대전 이래 지속되
고 있는 변호사협회 가입시 변호사에게 요구되는 전복적 활동단체와의 연계를 부인할 것을 서약하는 충성선서 및 미국에서 주로 각 주법에 의해 규정되고 있는 교사와 교수에 대한 충성선서 등 선서문에 대한 서명과 제출을 요건으로 하
는 충성선서들은 그 사회가 통합과 배제의 어느 쪽을 더 필요로 하는지에 따라 강화 혹은 완화되어 온 상관성을 보여준다.
민주주의 체제에서 관용의 일정한 한계로서, 사회존립의 공통기반으로서 애국심을 드러내주는 충성선서제도는 선서자의 내면과 행동을 통제하고자 하는 그 목적으로 인해 개인의 헌법적 권리를 침해하고 반대자들을 차별함으로써 충성선
서가 의도한 바로 그 사회통합에 역행한다는 아이러니를 야기한다.
인민의 자기통치체제인 민주주의의 헌법은 이미 그 스스로 비정통적이고 비주류적인 사고에 열려 있으며, 그럴 때만이 강제에 의한 복종과 순응이 아니라, 진리에 바탕을 둔 확신으로서 국가에 대한 신뢰, 공동체내에서 자기의 자유가 실현
될 수 있으리라는 신뢰를 고양시킬 수 있다. 따라서, 애국심을 외적으로 강제하는 충성선서제도는 다원적 가치관의 존중과 소수자 보호에 기반한 민주주의 헌법의 기본원리에 비추어 수용될 수 없다.
영문 초록
The democratic system, the dominant constitutional system of the modern state, puts value neutrality and plurality at its core. That is to say, the rule of a particular ideology should be ruled out and the various ideologies
accepted into the system. However, as a form of inclusion that requires all stakeholders to participate, democracy reveals the contradiction that some degree of exclusion is inevitable for its effective operation.
A clear example of the tension between the inclusion and exclusion of these democratic systems is the loyalty oath system that distinguishes “friends” from “enemies” based on the emphasis on patriotism. Loyalty
oaths were stressed when the times demanded a strong integration of the community. Especially, political loyalty oaths have been imposed on teachers and professors who are in charge of education for future
community members, and lawyers who are the core class of the system and public opinion.
Loyalty oaths can be divided into oaths that affirmatively pledge to uphold and support the Constitution and laws, and negative oaths that pledge not to betray the government and they are not involved in subversive organizations. The latter, in particular, has served as guilt by association by expanding to those who have no specific intent to the
group’s illegal purposes.
Loyalty oaths required to a particular target at home and abroad show the correlation that has been reinforced or mitigated depending on which side the society needs more consolidation and exclusion.
The loyalty oath system, which reveals patriotism as a certain limit of tolerance in a democratic system and as a common foundation for social existence, creates an irony that it runs counter to the very social unity
intended by the oath by infringing on the individual s constitutional rights and discriminating against the opponents.
The democratic constitution, the self-governance of the people, is already open to unorthodox and non-mainstream thinking on its own. Only in such constitution, we can raise our trust in the nation, our trust in the
community as a truth-based conviction, not in obedience and compliance by coercion. Thus, the system of loyalty oaths, which externally compels patriotism, cannot be admitted in the light of the basic principles of the
democratic constitution based on the respect of pluralistic values and the protection of minorities.
