국문 초록

이 연구는 3 1운동을 헌법사적 관점에서 재평가하고 이로 인해 제정된 대한민국임시헌장과 민주공화국 수립의 관계를 살펴보고자 하였다. 우선 3 1운동의 배경, 성격, 평가를 파악하고, 3 1운동이 대한민국임시헌장 제정에 미친 영향을 규명하였다. 3 1운동 당시 독립선언문은 민주공화국을 명시하지는 않았지만 3 1운동의 사상은 민주공화적 요소들을 내포하고 있었고 그것은 이후 임시정부 헌법제정에 영향을 미쳤다. 독립선언문에 담긴 사상과 3 1운동 전후 제기된 주권재민사상과 계몽주의는 당시 우리나라에서 인식한 공화주의로 설명하기에 무리가 없다고 보았다. 3 1운동의 결과 제정된 임시헌장에서는 민주공화국이 강조되었는데, 이는 임시헌장의 초안을 작성한 조소앙의 영향과 이전 시기에 공화주의 개념을 수용한 결과였다. 민주공화국 사상은 당시의 인식으로는 군주의 배제와 민주 주의, 균등 사상, 의회주의와 법치주의 등이 중심이었다고 할 수 있다. 3 1운동은 민족독립운동을 넘어 대한민국 임시정부 수립과 민주공화국 건설에 결정적 기여를 한 것이고, 임시정부 헌법을 통해 공화국 사상으로 구체화되었다. 민주공화국 규정은 임시정부를 거쳐 1948년 헌법 제정과 1987년 개정된 현행헌법에까지 일정한 영향을 미치고 있다.

영문 초록

The purpose of this study is to reevaluate the 3 1 Movement (1919 Korea Independent Movement) from a constitutional history perspective, and to examine the relationship between the Provisional Charter and the establishment of a Democratic Republic. First, this study examined the background, characteristics and evaluation of the 3 1 movement, and the impact of the 3 1 movement on the Provisional Charter of the Republic of Korea. Although the Declaration of Independence at the time of the 3 1 movement did not specify a democratic republic, the ideology of the 3 1 movement contained democratic and republican elements, which subsequently influenced the drafting of the provisional government constitution. It seemed reasonable to explain the ideology contained in the Declaration of Independence and the idea of sovereignty and enlightenment raised before and after the 3 1 movement as republicanism recognized in Korea at that time. In the Provisional Charter that was established as a result of the 3 1 movement, the Democratic Republic was emphasized, which was the result of accepting the concept of republicanism in the previous period and the influence of So-Ang Cho in drafting the Provisional Charter. Democratic republican ideology was based on democracy, egalitarianism, parliamentarism, rule of law and the exclusion of the monarchy. Beyond the national independence movement, the 3 1 movement was a decisive contribution to the establishment of the Provisional Government of the Republic of Korea and the Democratic Republic of Korea, and was embodied in the ideology of republic through the provisional government constitution. Democratic Republic regulations have had a certain impact on the constitutional law enacted in 1948 through the provisional government, and the current constitutional law amended in 1987.
