대한민국임시정부 법통 계승의 의미

국문 초록

최근 대한민국임시정부의 역사적 의미를 재해석하려는 경향이 강하게 대두되고 있다. 그런 가운데 불필요한 갈등이 확산되는 현상도 나타나고 있다. 이런 문제를 극복하기 위해서는 역사적 사실(fact)의 엄밀한 해석이 필요하다. 특히 대한민국임시정부의 역사적 의미, 그리고 현행헌법 전문(前文)에 명시되어 있는 ‘대한민국임시정부의 법통 계승’의 실질적 의미를 밝히는 것은 매우 엄격한 논증을 거쳐야 한다. 단순히 역사적 사실에 기초한 주장임을 확인하는 것이 아니라 그 사실의 의미가 합리적으로 해석되고 있다는 점을 논증해야 한다는 것이다. 이 논문에서는 대한민국임시정부의 법통이 무엇이며, 이를 계승한다는 말의 의미가 무엇인지를 정확하게 분석하기 위해서 먼저 ‘3 1운동의 역사적 의미와 대한 민국임시정부의 탄생’을 통해 그 배경을 개관한 이후에 ‘대한민국임시정부의 성격과 국제법적 지위’와 ‘해방 이후 대한민국임시정부의 헌법상 지위’를 고찰함으로써 대한민국임시정부의 성격과 지위를 규명하고, 그 기초 위에서 ‘대한민국임시정부 법통 계승의 의미와 기능’을 정리하였다. 이를 통해 1987년 헌법개정을 통해 ‘대한민국임시정부의 법통 계승’을 명시한 의미를 세 가지로 정리하였다. 첫째, 임시정부의 정당성과 정통성을 뒤늦게나마 인정한 것이다. 해방 이후 임시정부는 미군정에서 공식적 지위를 인정받지 못했을 뿐만 아니라 정부수립 후에도 아무런 공식적인 평가를 받지 못했다. 늦게라도 임시정부를 공식적으로 인 정함으로써 올바른 평가를 내리는 것이 필요했던 것이다. 둘째, 해방 이후 임시정부가 건국 및 정부수립의 주체가 되었다면 대한민국의 역사는 달라졌을 것이지만, 미군정과 이승만의 집권으로 인해 역사의 흐름은 다른 방향으로 흘러갔다. 임시정부의 법통 계승은 이러한 역사의 흐름을 되돌리는 것이 아니라 조금 더 올바른 방향으로 변경하고자 하는 것이다. 그런 의미에서 대한민국의 탄생 자체를 임시정부로 소급시키는 것보다는 임시정부의 정신을 대한민국이 계승한 것으로 해석하는 것이 옳다. 셋째, 임시정부의 법통 계승이 대한민국의 모든 것을 결정하는 것은 아니지만, 자주독립의 헌법정신을 강조한다는 의미는 결코 과소평가될 수 없다. 그런 의미에서 임시정부의 법통 계승을 일제 잔재의 청산 및 독립유공자의 예우 등에만 소극적으로 적용하지 않고, 보다 적극적으로 확산시키는 것도 필요하다.

영문 초록

Recently, there is a strong tendency to reinterpret the historical meaning of the provisional government of the Republic of Korea. In the meantime, unnecessary conflicts are spreading. To overcome these problems requires a rigorous interpretation of historical facts. In particular, the historical meaning of the Provisional Government of Korea, and the substantive meaning of ‘the Inheritance of Legitimacy of the Provisional Government of the Republic of Korea’ specified in the preamble to the current Constitution, must undergo a very strict argument. It should be argued that it is not merely an assertion based on historical fact but that the meaning of the fact is reasonably interpreted. In this article, to analyze precisely what the meaning of the provisional government of the Republic of Korea is and what it means to inherit it, we first outline its background through the historical meaning of the 3 1 movement and the birth of the Provisional Government of the Republic of Korea. After reviewing the character of the Provisional Government of the Republic of Korea and its international legal status and the status of the Provisional Government of the Republic of Korea after liberation, the character and position of the Provisional Government of the Republic of Korea were identified. On the basis of this, I have summarized the meaning and function of the inheritance of legitimacy of the Korean Provisional Government. In the 1987 amendment of the Constitution, the meaning of “the inheritance of legitimacy of the Provisional Government of the Republic of Korea” was summarized in three ways. First, it acknowledges the legitimacy of the provisional government. Since liberation, the Provisional Government has not only been officially recognized in the US military government, and has not received any official evaluation even after the establishment of the government. Even late, it was necessary to formally evaluate the provisional government to make a correct assessment. Second, the history of the Republic of Korea would have been different if the Provisional Government became the subject of the founding and the establishment of the government after liberation. However, the history in the US military government and the administration of Seungman Rhee had flowed in different directions. The inheritance of legitimacy of the provisional government is not to reverse this history, but to change it in the right direction. In this sense, it is right to interpret the spirit of the provisional government as the succession of the Republic of Korea, rather than to retroact the birth of the Republic of Korea itself as a provisional government. Third, although the succession of the provisional government does not determine everything in the Republic of Korea, it can not be underestimated that it often emphasizes the constitutional spirit of independence. In this sense, it is also necessary to actively disseminate the succession of the provisional government, rather than passively applying it only to the clearing of the remnants of the Japanese monarchy and the honor of the independents.
