국문 초록

많은 논란을 거친 법학전문대학원제도가 실시되고 3년의 교육을 마친 1기생들이 2012년 초에 실시될 변호사시험을 칠 것이다. 2012년에 배출될 사법연수생 1,000명과 로스쿨생 1,500명 합계 2,500명의 신진 변호사에 대하여 관련 기관의 준비는 아 직 부족하다. 특히 어려운 국내 변호사시장 상황에 비추어 새로운 변호사들에 대한 우려도 적지 않다. 그러나 로펌에서 3학년 학생들의 진로에 대한 선택을 한 경우도 있으므로 비관적인 것만은 아니다. 그러한 상황에서 법무부는 2012년의 변호사시험 에 대비하여 모의고사를 2회나 실시하였다. 회원들의 열망에 따라 한국행정법학회가 출범하고 2회 학술대회 주제로 ‘로스쿨시대의 행정법교육’을 정하였다. 변호사 실무 경험이 있는 로스쿨교수로서 ‘변호사시험에 있어 행정법분야에 대한 출제방향’이란 소주제로 발표하게 되었다. 실무와 교육현장의 경험을 바탕으로 위 주제를 로스쿨 교육목표와 교육과정, 변호사시험과 행정법분야란 소제목으로 나누어 기존의 논의와 제도 정착과정을 정리하고 2회에 걸친 법무부 모의시험을 검토하였다. 시험이란 교육을 전제로 하므로 현행 로스쿨 교육목표와 교육과정을 살펴보지 않을 수 없다. 기존의 많은 논의와 실정법의 검토 그리고 관련 로펌과 국가기관의 실무 교육과정을 살펴보니 상당히 잘 하고 있다는 평가를 받을 만하다. 변호사시험제 도에 대한 관련 규정과 전반적인 준비과정을 검토하면 초기의 어려움은 무난히 극복되었다고 할 것이다. 법무부가 2회에 걸쳐 시행한 변호사시험 모의고사 중 공법분야에 대한 개괄적인 고찰을 하면 헌법과 행정법의 영역이 중복된다는 것을 알 수 있 다. 실제 소송실무에서도 사건을 수임한 변호사가 행정소송과 헌법소송을 병행하여 진행할 수 있는 것에 비추어 사례형과 기록형 시험문제에서도 함께 물을 수 있다. 그 중에서도 행정법분야는 범위가 광범위하고 관련 법규가 방대하므로 보다 적극적인 공부가 필요하다. 그리고 대법원의 전원합의체 판결이 계속 선고되고 있으므로 동태적인 판례의 흐름을 충분히 이해해야 할 것이다. 그러한 바탕 위에 새로운 시험유형인 기록형에 대비하고, 보다 실무적인 사례형 시험을 준비하면 무난히 변호사시험을 통과할 것이다.

영문 초록

Law School system has executed in Korea for 3 years with a lot of discussion. In 2012 january, the first bar examination will be held. There are no positive preparations for the new 2,500 lawyers that is composed of 1,000 students of the Judicial Research and Training Institute and 1,500 students of Law School in our society. Specially the difficult situation in law market has made a great worry for the new enormous number of lawyers. But we need not give up our hope, because law firms has chosen some number of law school student. In that situations, the Ministry of Justice carried out 2 trial exams for bar exams in 2012. Korean Administrative Law Association has been formed by the ardent wish and has decided administrative law education in law school times as second main subject. As a professor with practical experience I prepared the subject which is called the aim and level of administrative law questions in bar examination . I have divided that subject into the aim and course of law school education and bar examination and administrative law field . I has studied the existing debates and the trial exams. The examination is assuming the teaching and education. So we should investigate the present system of law school. When I studied the existing debates and related law and the educational process of law firms and state organs, I estimated them highly. When we investigate trial exams. made by the Ministry of Justice, we could find the overlapping of constitutional law and administrative law. On cases in litigation, lawyer has tried administrative litigation and constitutional itigation. So to prepare public law examination, students should study two litigation question. Administrative law has enormous bound and a lot of Acts. The Supreme Court has continuously sentenced decision with all members. So student should understand that stream of administrative law case by the Supreme Court. If students would prepare that point, they will pass administrative law examination.
