국문 초록

정법 학자가 어떠한 역할을 하여야 할 것인가를 조망하는 것이다. “행정법학”은 “행정에 관한 법”을 연구하는 “법학”의 한 분야이다. “행정법학”의 역할은 행정에 관한 법의 정립 집행 평가와 행정으로 인하여 피해를 입은 국민들 이 논문의 연구목표는 한국행정법학회의 창립의 의의로서 국가발전을 위하여 행의 권리구제 등 행정과 관련된 법현상을 학문적으로 연구하는 학문이다. 연구목표를 달성하기 위한 연구 내용의 채택에 있어 다음과 같은 논리적 순서를 고려하였다. 제1단계로서 국가발전과 행정법학은 서로 어떠한 관계를 가지는가에 대한 검토가 필요하다고 판단하였다. 먼저 행정법학의 기본적 의의를 현대 행정법학의 기능적 분석에 따라 정리하였다. 그 결과 행정입법학, 행정조직법학, 행정작용법학 및 행정구제법학으로 구분하고, 각각의 현대적 의미를 제시하였다. 다음으로 현대 자유민주적법치국가를 정립해 나감에 있어 행정법학의 중요성을 강조하였다. 끝으로 국가발전에 수반되는 법질서의 역동성을 행정법학이 부응하지 못하는 문제점을 사례를 들어 제시하였다. 다음 단계에서 국가발전에 있어 개별적인 행정법학자가 담당하여야 할 역할을 그 다양성의 측면에서 구체적으로 정리하고자 시도하였다. 그 결과 정책형성과정, 정책 집행과정, 정책 평가 및 환류 과정, 정책 관련 권리구제, 행정법현상에 대한 교육기 능 등으로 나누어 분석하고, 현실에 있어 가지는 한계와 문제점을 구체적 사례를 들어 제시하였다. 마지막으로 국가발전을 위하여 행정법학자의 집단으로서 새로이 출범하는 한국행정법학회가 담당할 과제를 정리하였다. 먼저 한국 행정법학회를 한국공법학회와의 상호관계에서 분석한 후, 사회적 수요 및 교육적 수요에 비춘 설립의 당위성에 초점 을 두고 설명하였다. 이어서 한국행정법학의 과제를 총론 행정법학의 이론체계의 심화, 개별 행정법학의 다변화와 행정법학의 저변 확대, 민사법학 형사법학 등 다른 법학분야와 행정학 자연과학 등 다른 학문분야와 행정법학의 상호관계 정립, 각종 공공기관과의 관계 정립 및 국제사회에서의 위상 정립 등으로 나누어 정리하였다.

영문 초록

This article was written for the Key-note speech of the Establishment General Assembly of the Korean Administrative Law Association. The purpose of this paper was to overview the role of the Administrative Law Scientists for the national development. Three contents were presented step by step to achieve this purpose. First, the relationships between the national development and the role of the Administrative Law Science(ALS) were investigated. The basic meanings of it were readjusted according to the results of the functional analysis of the modern ALS in this stage; ALS can be classified into the Sciences of the Administrative Rule Making, of the Administrative Organizations, of the Administrative Activities, of the Administrative Remedies and Procedures. The recent problems of the discrepance between the ELS and the dynamic characters of the modern governmental activities were analysed on the basis of some korean practical cases. Second, the various roles of the individual scientists for the national development were arranged. They are very different in the stage of the policy making, enforcement, evaluation and circulation. The administrative law scientists have to educate not only the law school students but also the employees of the agencies and the customers of the administrative services. The limits and the problems of the scientists in the dynamic administrative situations were concretely presented. Last, the tasks of the Korean Administrative Law Association(KOALA) were enumerated, which newly opened as a assembling body of the scientists and practitioners who are specialized in ALS. The KOALA and the Korean Public Law Association need complementary cooperation. The KOALA have to meet the political, social and educational needs. Her tasks are deepening the theory of the administrative laws and procedures, multiplying the individual areas of the scientific areas of the special administrative laws, arranging the relationships among the ALS and other law sciences as Civil Law, Criminal Law and International Law Science and othe social sciences as Sociology, Politics and Public Administration. The KOALA have to enlarge her connections not only with the korean agencies and non-governmental organizations but also with the international scientific associations and researching bodies.
