미국의 수입식품에 대한 제3자 인증제도에 관한 연구

국문 초록

본 연구에서는 미국정부가 식품안전선진화법(FSMA)의 수행을 근거로 FDA가 제정한 제3자 인증제도(Accredited Third-Party Certification Program : ATPCP)의 주요 내용을 살펴보았다. 그리고 이러한 제3자 인증제도의 적용을 받는 수입식품에 대한 안전관리제도로써 자율적 수입자적격프로그램(Voluntary Qualified Importer Program : VQIP)과 해외공급자검정프로그램 (Foreign Supplier Verification Program : FSVP)을 분석해 보았다. 본 연구에서는 미국의 제3자 인증제도가 WTO 체제 내에서 어떤 평가를 받을 수 있는지에 대한 제도적 의미를 찾아보았다. 분석을 통하여 미국의 제3자 인증제도는 WTO SPS 협정과 TBT협정에서 관련 제도의 적용에 전제가 되는 ‘동등성(equivalence) 원칙’을 실현할 수 있는 차선의 대안 제도로서 의미를 가진다는 것을 알수 있었다. 그리고 제3자 인증제도는 수입허 가절차의 일환으로 진행되는 선적전 검사로서, 무역원활화를 제고하기 위한 대안으로서 의미를 가지는 제도였다. 마지막으로 본 연구에서는 제3자 인증제도(ATPCP)와 VQIP, FSVP에 대한 제도적 분석과 WTO 체제 내에서 미국의 ATPCP에 대한 국제통상법적 평가를 바탕으로 미국의 ATPCP를 국제 제도로 발전시키거나 또는 국제협력을 위한 틀(framework)로 만들기 위한 3가지 정책적 제언을 제시했다.

영문 초록

Purpose : This paper is to study on the evaluation of the FDA’s Accredited Third-Party Certification Program(ATPCP) under the US’s Food Safety Modernization Act(FSMA) Research design, data, methodology : This paper conducted the institutional research using international trade law and the literature research to other studies on the US’s Accredited Third-Party Certification Program(ATPCP). Result : This paper have analyzed the Voluntary Qualified Importer Program (VQIP) and the Foreign Supplier Verification Program (FSVP) as a safety control system for the imported food subject to US’s ATPCP. And this paper investigated the institutional assessment of the US’s ATPCP what kind of evaluation will receive in the WTO system. Through the study was able to know that the US’s ATPCP has significance as a second alternative system that can realize the equivalence which is the principle for the application of the related system under the WTO SPS Agreement and the WTO TBT Agreement. And this paper was find that US’s ATPCP is a pre-shipment inspection conducted as part of the import licensing process, which is an alternative system to enhance trade facilitation. Conclusion : Based on the institutional analysis of Us’s ATPCP, VQIP and FSVP, and the evaluation of the international trade law in the WTO system, this study presented three policy proposals to make the US’s ATPCP into a framework for the internationalization or for the international cooperation.
