국문 초록

지난 2017년 9월 12일, ‘중국국제경제무역중재위원회’(CIETAC)는 국제투자분쟁과 관련한 중재활성화의 일환책으로서, ‘국제투자분쟁중재규칙’(国际投资争端仲裁规则)을 채택하고 같은 해 10월 1일부터 시행에 들어갔다. 지금까지 CIETAC는 당사자간 중재합의에 근거해 사인 간의 국제적 상사분재사건만을 전담하여 왔으나, CIETAC 투자중재규칙의 시행에 따라 향후 중국 정부 또는 중국 기업과 관련된 투자협정중재의 구체적인 실무체제는 CIETAC라는 기관 중재를 통해 육성될 것으로 전망된다. 다자간 혹은 양자간 투자협정이 증가하고 있는 국제적 현실에 비추어, CIETAC 투자중재규 칙은 향후 중국식 해외투자의 활성책 내지는 유지책의 일환으로 정착될 것이다. 특히 중국 정부가 일대일로 정책을 국가정책으로 채택하면서 투자자본의 보호와 회수를 위해 CIETAC 투자중재규칙을 분쟁해결 인프라의 하나로도 활용할 것으로 예상된다. 본 논문에서는 이점에 주목하여 2017년 제정된 CIETAC 투자중재규칙에 대해 그 주요 내용들을 소개하고 검토해 보았다.

영문 초록

Purpose : The purpose of this paper is to introduce and analyze the China International Economic and Trade Arbitration Commission (CIETAC) Investment Arbitration Rules which came into force on 1 October 2017 in China. Research design, data, methodology : This paper studies scopes, application, jurisdiction, administrations, formation of the arbitral tribunal, and arbitral procedures of CIETAC Investment Arbitration Rules by analyzing articles. The paper, also, studies CIETAC Investment Arbitration Rules by comparing specifically international treaty (etc. ICSID Conventions or ICSID Arbitration Rules), rules, or practices. Results : CIETAC Investment Arbitration Rules presage China taking its own, distinct role in the resolution of international investment disputes, particularly those involving Chinese investors. However, it remains to be seen what gap exactly the Rules will fill. Matters arising on One Belt and One Road projects may provide opportunities to observe how the Rules might play a role in China-related investor-state arbitrations. Conclusions : This paper analyzes CIETAC Investment Arbitration Rules on 2017 and suggests some practical implications for international investment dispute resolutions. It remains to be seen how widely both the Rules, and CIETAC as an investor-state dispute resolution institution, will be accepted.
