국문 초록

대한민국의 헌정사 쓰기는 여러 차례의 헌정 중단을 설명하는데 어려움을 겪고 있다. 이 점을 절감하면서 나는 알랭 바디우의 ‘사건’의 철학에 기대어 1987년 헌법의 형성과정을 헌법정치학의 관점에서 살펴보려고 한다. 6월 민주화 대항쟁의 전말을 요약한 뒤, 나는 대한민국 헌정사를 두 개의 정치적 ‘사건’이 낳은 진리체계의 투쟁과정으로 설명한다. 하나는 정치를 비상사태 속의 생존과 적응으로 축소시켰던 한국 전쟁이고, 다른 하나는 정치를 일상적 삶 속의 말의 자유와 행복 추구로 복원시켰던 6월 민주화 대항쟁이다. 6월 민주화 대항쟁은 대통령 직선제 개헌에 대한 사실상 만장일치의 합의를 고리로 전자에 대하여 후자를 맞세움으로써 자유민주주의라는 억압된 체제 이념을 부활시킨 과정이었다. 다만, 그 때문에 1987년 헌법은 한국 전쟁과 6월 민주화 대항쟁이라는 두 정치적 사건의 타협을 반영할 수밖에 없었다. 2016년 10월말부터 2017년 5월초까지 벌어졌던 헌법정치의 드라마틱한 전개과정은 대한민국 헌정사에 1987년 헌법의 한계를 극복할 헌법적 주체의 형성 문제를 제기하고 있다.

영문 초록

There has been a great deal of difficulty in writing the constitutional history of the Republic of Korea due to some periods of military government in which Korean constitution was suspended for a while. Acutely realizing this difficulty, I would like to review the formation process of the 1987 constitution of Korea in the light of the philosophy of EVENT suggested by a modern french thinker of Alain Badiu in recent decades. After summarizing the story of the June Democracy Movement of 1987, I try to explain the constitutional history of Korea as a kind of struggling process between two different truth-system in Badiu’s term, which are the results of two different political EVENTs; Korean War between 1950-3 and the June Democracy Movement of 1987. The former has shrunk politics into a kind of emergent survival and adaptation, while the latter has revived politics as freedom of speech and pursuit of happiness in ordinary lives. The June Democracy Movement of 1987 was a reviving process of the repressed ideal of liberal democracy by facing the demand of constitutional revision focused upon the direct 리ection of the president. Because those two political EVENTs were struggling against each other in 1987, current constitution, which is a result of the constitutional politics of 1987, could not but contain many cases of compromise between those two truth-systems in the constitutional document. In this regard, a very dramatic process of Korean constitutional politics in 2016-7 including the presidential impeachment raises the need of constitutional subjects who can overcome the limit of the 1987 constitution in near future.
