KCAB 개정 국제중재규칙 주요 특징에 관한 연구

국문 초록

한국은 중재와 관련된 세계적 변화에 부응하고자 한국의 중재기관을 국제 기업분쟁 해결기관의 허브로 육성하기 위하여 중재법 개정과 더불어 중재산업진흥법을 제정하여 이러한 중재제도의 경쟁력 확보와 법률서비스 분야 무역수지 적자를 개선하고자 하였다. 즉, 법률서비스 분야 국제수지 적자를 해소하고, 중재분야의 국제경쟁력를 향상시키기 위하여 주관부서를 법무부로 이관하고, 중재법을 대폭 개정하였다. 대한상사중재원도 국내외적인 환경변화에 능동적으로 대처하고, 경쟁력을 향상시키기 위하여 국제중재규칙을 대폭 개정하였다. 대한상사중재원의 국제중재규칙은 상학적인 측면에서 단일 거래에서 복잡하고 복수의 당사자가 개입되는 무역분쟁을 보다 단일 중재신청규정이나 청구의 병합조항의 신설로 보다 탄력적이고 효율성을 꾀할 수 있게 되었고, 긴급중재제도의 도입으로 중재판정의 집행이 보다 용이해져 무역계약체결시 대한상사중재원을 중재기관으로 정하도록 설득하는 데 도움이 될 것으로 보이며, 마지막으로 중재판정의 공개로 국제적으로는 투명성을 보장받을 수 있으며 국내적으로 상학분야에 좋은 콘텐츠를 제공하여 학문분야의 발전이나 교육의 질을 높일 수 있게 되었다.

영문 초록

As the rapid resolution of disputes through neutral arbitration institutions is gradually becoming a global standard , each country has amended its Arbitration Act to reflect the UNCITRAL modal law. Many arbitral institutions also amend its arbitration rules to provide the highest quality services and procedural rules in order to compete with each other. In keeping with this international trend, the Korean government and KCAB has also amended the Arbitration Act, and the International Arbitration Rules, respectively in 2016. This article aims at contributing to research and education in the field of international trade studies and to develope the arbitration system in Korea in accordance with the amendment of KCAB s international arbitration rules. KCAB have amended their arbitration rules by introducing modern and user-friendly mechanisms, such as single arbitration under multiple contracts, consolidation of claims, emergency arbitration and confirmation of arbitrators. These revised rules continues to provide more flexible and state of the art arbitration rules for ever more complicated patterns of international trade disputes. To improve the international competitiveness of the Korean arbitration system, the Korean government and KCAB should promote the arbitration system with the revised arbitration rules and create an environment that can be widely used in Korea and world. They should provide incentives for domestic companies to convert their international commercial disputes in ICC or Singapore to domestic ones. In the field of international trade studies, it is also necessary to improve the quality of education through academic research that evaluates cases of arbitration award, as well as education using them.
