국문 초록

우리나라 문화재 관련 기본법 역할을 해온 「문화재보호법」이 1962년 제정된 이후, 문화재의 중요성과 주무관청의 정책적 중요성이 배가되면서, 최근 들어 「문화재보호기금법」, 「문화재수리 등에 관한 법률」 및 「매장문화재 보호 및 조사에 관한 법률」, 「무형문화재 보전 및 진흥에 관한 법률」 등 분법화가 가속화되는 등 문화재 행정이 점점 전문화되고 있다. 문화재를 둘러싼 대·내외적 환경변화를 수용하기에는 문화재보호법이 그 역할을 다하지 못하고 있는 것이 현실이다. 또한 문화재 보호라는 속성을 지닌 규제 중심적 법률 체계는 문화재 진흥, 향유, 기본권, 산업 등의 개념과 충돌할 수 있어 법정책적 관점에서 확장성이 용이하지 않다. 따라서 기존의 정책 범위를 확장시킬 수 있는 새로운 법률 체계를 정립하는 것이 필요하다. 본 연구에서는 문화재 기본법령 체계 재구축에 대한 연구를 통하여, 최근 빠르게 변화하는 환경에 부합하기 위한 문화재 정책의 방향검토를 통해 문화재 기본법령이 나가야할 방향성을 모색하였다. 특히 문화재 법령이 정책기능 뿐만 아니라 문화재 유형에 따라서도 분법화되고 있는데 미래 관점에서는 특수한 문화재 유형(천연기념물 등)이 아닌 경우 기능별 분법이 더 바람직하다고 할 수 있다.

영문 초록

After 「The Cultural Properties Protection Law」 that has played the role of the primary legislation for our Cultural Properties was legislated in 1962, as the importance of Cultural Properties and the policy importance of competent authorities were doubled, recently, the legal system including 「The Cultural Properties Protection Fund Law」and「The Law for Cultural Properties Repair」 has been accelerated. The Cultural Properties Protection Law hasn’t played its sufficient role to accept the environmental change surrounding cultural properties. Also, as the regulation-centric legal systemization with the attribute of cultural properties protection may conflict with the concept of cultural properties promotion, enjoyment, basic legal rights and industry, etc., at the point of view of laws and ordinances, the expandability isn’t easy. Therefore, it is necessary to formulate new legal system that can expand the existing policy range. This study tried to find the directional nature that the primary legislation should proceed through the directional review of Cultural Properties Policy for matching up to the recent fast-changing environment. In particular, the Cultural Properties Law has been legally systemized according to the Cultural Properties type as well as the policy function, however, at the future point of view, it is considered that the functional systemization is more desirable if it is not a specific Cultural Properties type(including natural monument).
