실종자 문제에 관한 법적 고찰:

국문 초록

실종은 가족관계와 사회관계를 황폐화 시키는 사회적 문제다. 실종 문제가 가 장 큰 문제점은 실종사건 관계자인 가족에게 치명적인 심리사회적인 문제를 야기 시킨다는 것이다. 실종 문제는 가정의 붕괴와 가족 구성원의 파탄을 초래할수 있다. 실종 문제는 개인과 가족뿐 아니라 사회 전체의 큰 문제이다. 국내에서 발생하는 실종사건은 해마다 증가하고 있는 추세다. 실종사건은 범죄로 이어져 실종자가 생명을 잃게 되어 가족한테 돌아가지 못하는 경우가 많다. 특히 아동이나 여성이 범죄의 대상이 되어 피해를 입는 경우가 많다. 그리하여 정부에서는 실종자 문제에 대한 많은 대책을 내 놓았지만 효과적이지 못하다. 따라서 국내에서의 실종자 사건을 해결하기 위한 프로그램으로서 영국과 호주의 실종사건 대처 방안에 대하여 알아보았다. 영국에서는 실종자지원센터(Missing People)를 운영하고 있다. 본 센터는 1993년에 자선재단으로 등록되어 실종자 가족을 위하여 실종자 수색과 실종자 가족의 고통을 없앨 수 있는 전문적 지원 사업을 수행하고 있다. 또한 국가 차원의 실종 아동․성인 전략(Strategic Objectives Framework)을 수립하여 수행하고 있다. 이 같은 전략과 계획의 수립은 실종 문제를 초동(初動)에 해결할 수 있는 단서와 방향을 제공함은 물론 실종사건에 대한 대응과 예방에 효과적이다. 그리고 호주에서는 정부를 주축으로 1990년 중반 실종자 현황에 대한 국가적 조사를 실시했다. 특히 실종신고와 관련한 대응 활동의 개선을 위해 노력해 왔다. 그래서 호주 경찰장관위원회(Australasian Police Ministers’ Council)은 2006년 7월 국가 차원의 실종자 정책을 발표하여 실종자 관련 활동에 대한 기본틀을 제공하였다. 특히 실종자에 대한 수색과 정보 공유를 위하여 최대한 노력하고 있다. 특히 실종 문제에 대한 국민의 인식제고와 지원을 위하여 실종자 수색 프로그램을 방송하고 있다. 그래서 실종자에 대한 인식을 크게 제고하고 있다. 영국과 호주와 같은 경우는 실종자에 관련한 문제는 정부의 예산지원으로 민간기관에 의해 운영되고 있다. 그래서 사법기관, 행정기관 등과 유기적인 협조체계가 이루어지고 있다. 이는 실종 아동, 유괴, 아동 착취 등을 포함하여 대처하고 있다. 현재 우리나라의 아동실종사건의 현황을 살펴보면 사건 해결률은 높지만 아동실종사건의 발생률이 꾸준히 높게 나타나는 문제점을 안고 있다. 아동실종사건이 일어나면 실종아동과 가족들에게 크고 작은 심적ㆍ금전적 피해가 나타날 수 있다. 그리하여 국가는 최우선적으로 실종자 가족들의 고통을 헤아려 계속해서 더 나은 정책과 프로그램을 개발하고 도입해야 할 것이다. 그래서 경찰과 민간단체,언론, 공공기관, 국민 모두가 관심을 갖고 실종사건에 대처해야 할 것이다.

영문 초록
