프랑스 도핑방지 법제의 내용과 시사점

국문 초록

1980년대 뚜르 드 프랑스(Tour de France) 도핑파문 이전부터 프랑스에서 스포츠 분야의도핑 문제는 스포츠 윤리뿐만 아니라 민·형사상 법적 책임을 가져오는 사회적 이슈가 되어왔다. 오랜역사를가진도핑에대한논란과규제의문제는스포츠종사자개인뿐만아니라일부 국가의 경우 정치적으로 이를 용인하고 있는 점에서 복잡한 양상을 나타내고 있다. 도핑문제는 이를 피하려는 쪽과 또 이를 과학적으로 찾아내고 규제하려는 쪽 모두다 의약기술의 발전과 과학적 도구의 도움이 있어야 한다는 점에서 약물복용 금지와 예방에 관한규범적대응의시차가더벌어지고있다. 프랑스의도핑에관련된입법적노력은1965년의 ‘헤르조그(Herzog)법’, 1989년 6월 28일 법률, 1999년의 뷔페(Buffet)법과 2006년의 법률(약물보호와 선수건강법)의 제정을 통해 체계적이고 조직적으로 정비되었고, 현재는 스포츠법전(Code du sport)에서 규정하고 있다. 스포츠법전에 규정된 프랑스 도핑방지위원회(AFLD)는 도핑의 예방과 방지 그리고 규제권 행사에 있어 중요한 지위를 차지하고 있다. 프랑스 최고행정법원인 꽁세이데타는 위 기관의 공권력 행사자로서의 지위를 인정한 바 있다. 프랑스에서 도핑방자를 위한 정부차원의 노력은 2015-2017년 기간 동안의 금지약물 사용과 복용예방을위한국가계획을통해알수있다. 6대목표의14개의실천프로그램을담은동계획은 차별화된 대상 설정과 선별적인 정책을 추진을 목표로 하고 있는 점에서 우리에게시사하는 바가 크다고 본다. 도핑 현상과 이에 대한 방지와 제재절차나 구제방법은 프랑스도 우리와 마찬가지로 이른바 WADA CODE로 불리는 국제반도핑기구 규정이 정한 프로세스에 따라 진행되고 있다. 따라서 도핑과 관련해서는 국내 실정법규범과 국제규범간의 갈 등이나조화에 관한접근 보다는각 국가별로도핑에대한 정의와제도적 기반구축에대한입법정비의 문제가 중요함을 알 수 있다. 비교법적 관점에서 프랑스 스포츠법의 변화와 현행규정의내용을검토해보면, 적어도도핑분야는양자의수렴도가상당히높다고평가되며, 국내에서의 규제상황과유사한측면이 있다. 그러나도핑에 관한법제정비가빈약한 우리의 현실에 비추어 볼 때, 프랑스 도핑관련 법제에 대한 비교와 검토는 단순한 법조항의 단순비교에 그칠 것이 아니라 좀 더 전반적인 프랑스 스포츠법제에 대한 연구와 병행하여 이루어져야 할 것이다.

영문 초록

Doping which was associated to personal or national interest to enhance the results and record in sport performances has been a continuos social problem in spite of the national and international effort for fight to doping. In France, a doping phenomena,since 1960’s, not only raise ethical question but also touches legal problems in penal and public and private law. Doping is defined as the ingesting or using forbidden drugs or methods listed and announced by the public authority for enhancing players physical capabilities. But its definition was variable and changed by each national legislative position. In this study, we hope to present and find a comparative suggestion about the french anti-doping legal system which was guarantied by French Anti-Doping Agency (Agence française de lutte contre le dopage, AFLD). The history of anti-doping regulation in France trace back to the Act n°65-421 of June 1st, Known as 《Act of Herzog》and then Act n°89-432 of June 28th which reinforce the guaranty of process and administrative sanction by sports federation. But it was amended by the Act n°2006-405 of April 5th relative protection for doping and health of players, which was codified in second section of Chapter Ⅱ of TitreⅢ od Code of Sport since 2006. In France, the French Anti-Doping Agency(Agence française de lutte contre le dopage, AFLD) is an independent public authority created in 2006 and charged with ensuring that participants in sports do not violate rules regarding doping(art. L 232-5 of Code of Sport). It is characterized by diversity of its areas of expert and co-existance of an anti-doping organization and a accented laboratory constitutes many benefits. The dispute and lawsuit about doping has been considerably modified since the creation of WADA(World anti doping agency) by IOC(International olympic committee) in 1999. WADA made the World Anti-Doping Code that harmonizes anti-doping policies, rules and regulations within sport organizations and among public authorities around the world. Some of french sport law accept the world anti-doping code and thr disciplinary process and repeal mechanism was organized by AFLD because the prevention and repression cant’t be separated and they are both crucial policies. From the institutional and legislative perspective, french sport code was well organized the process and repression phase rather than korean legislative texts and it ‘ll be a good reference in order to enact appropriate Doping regulation in future in Korea.
