국문 초록

권리소진원칙은 저작권자와 저작물을 포함한 상품을 취득한 양수인과의 충돌을 해결하는 법리로 오랜 기간 동안 활용되어 왔으며, 그 근간을 이루는 요건은 권리소 진원칙이 최초로 논의될 당시의 저작물 이용 및 거래형태를 반영하고 있다. 그러나 디지털 기술의 발전으로 저작물 거래 및 이용방식에 일대 변화가 일어나면서，권리 소진원칙의 적용 요건과 간극이 발생하게 되었다. 디지털 형태의 거래는 유체물 형태의 거래를 상당부분 대체하고 있고 앞으로도 점점 증가할 것으로 예상되며, 대부분 비대면 계약으로 거래의 내용에 대한 교섭이 어렵고 저작권자가 조건을 일방적으로 설정한다는 점을 고려하면 이 같은 간극을 좁힐 수 있는 대응책이 필요하다. 따라서 현재 요구되는 권리소진원칙의 적용요건을 고수할 것이 아니라 해당 요건이 의미하는 바를 규명하여 디지털저작물 거래에 정합성 있는 요건을 정립해야 한다. 이에 따라 디지털저작물 거래계약을 분석하여 상품의 이전과 그 외의 부분으로 나누고, 양수인이 상품을 취득하고 보유하는 것에 대한 제한이 없었다면 복제물 소유권에 상응하는 권리를 취득한 것으로 보아 해당 상품의 사용 및 처분을 보장해야 한다. 이때 사용이나 처분을 제한하는 추가적인 라이선스 조항은 권리소진원칙으로 보장되는 행위를 저작권자가 통제하려는 시도이므로 저작권법상 효력이 없다고 보아야 한다. 한편 권리소진원칙은 배포권의 예외로만 규정되어 있으므로 양수인 및 전득자의 사용과 처분을 보장하려면 복제권의 추가적인 제한규정을 설치하고 배포 개념을 확장하는 방인:의 검토가 필요하다.

영문 초록

The exhaustion doctrine has long been used as a legal principle which resolves conflicts between the owner of copyright and the owner of a copyrighted products. Its underlying requirements were based on the way of trading and using copyrighted products in the early 1900s. However, as the advent of new technology has brought remarkable changes in the way of trading and using copyrighted products, the present exhaustion doctrine frequently conflicts with reality. Under the current copyright act, since the exhaustion doctrine allows assignee to dispose the product by limiting right of distribution, and it seems not to guarantee the assignee to use and dispose of digital product anymore. That is not reasonable, in that it is still strongly needed to resolve conflicts between the owner of copyright and the owner of digital products. Therefore, if the exhaustion doctrine s requirements are not satisfied because of the features of digital technology, they should be updated considering what the requirements really stand for. Hence, firstly, the concept of ownership should be interpreted flexibly in the light of the contract, so that if a digital product fully transferred, the subsidiary provisions of the contract for use or dispose would not be legally enforceable under the copyright act. Secondly, since the exhaustion doctrine is to ensure that the assignee can use or dispose of his copyrighted products unless the assignee harms the exclusivity of copyright, the copyright act needs to be revised so that the assignee’s act comes under limitations on the author’s property rights.
