국문 초록

3D 프린터를 이용하여 미국 오바마 대통령의 흉상을 만들거나, 고흐의 해바라기 그림을 3D 디자인 파일화 한 후, 새로운 예술품을 제작하는 일들이 일어나고 있다. 이점은 최근에 급속히 발달하고 있는 3D 프린팅 기술이 문화 · 예술의 영역에도 영향을 미치기 시작하고 있음을 의미한다. 3D 프린팅 기술의 구성요소인 3D 디자인 파일은 저작권법의 적용에 있어서 몇 가지 의문점을 안겨준다. 이는 3D 디자인 파일의 속성에서 연유한다. 3D 디자인 파일은 데이터여서 그 속성상 수정 · 변형이 용이 하며(변형 용이성), 온라인상에서 빠르게 확산될 수 있고(확산성), 물체에 대한 데이터 모델이므로 구현되는 물체와도 밀접한 관련성(물체와의 강한 관련성)이 있다. 또한 물체를 표상한다는 점에서 상당히 기능적이다(기능성). 이러한 3D 디자인 파일을 이용한 창작 활동과 그 창작물을 우리 저작권법에서 어떻게 취급하여야 할 것인지가 문제되는 바이다. 이러한 관점에서 본 논문은 3D 디자인 파일의 저작물성 판단에 있어서 스캐너를 이용할 경우에는 사진저작물의 판단방법과 비교하여 검토하였고, CAD 프로그램의 경우에는 프로그램의 표준 환경에 따라 제기될 수 있는 문제 등에 대하여 분석하였 다. 또한 3D 디자인 파일의 저작물 분류에 있어서 건축저작물 및 프로그램저작물에 대한 현행법상의 문제점을 도출하였다. 또한 3D 디자인 파일의 변형성과 관련하여 공정 이용에 대한 문제와 당해 저작물의 저작권 존부에 대한 특별한 평가 없이 이루 어지는 저작권법 제103조의 복제 · 전송 중단 시스템의 부담에 대해서도 검토하였다. 이와 같이, 3D 디자인 파일을 둘러싸고 제기되는 문제들은 향후 저작권법에 적지 않은 영향을 미칠 것이 예상되고, 향후 대응을 위한 검토의 필요성을 제기하였다.

영문 초록

In recent times, the 3D Printing industrial sector which is having an impact on the copyright field is growing at a surprising rate. The fact of the matter is the point of view how to think about the 3D design file as one of the components for the 3D printing. 3D design files can modify and transform easily and are essentially distributive and circulatory through online channel, have the characteristic that is called diffusion. And they are also the data model of the specific object, closely connected with embodied objects and that by itself is very functional. Especially the 3D design file is another expression of the 3D printed object on the formation of aspect. On the basis of this perspective, this paper attempts a comparative review on the copyright-ability of photography works to judge the copyrightability of 3D design files. Furthermore in the classification works of 3D design files, this paper also elaborates the problem of the current law in regard to architectural works and computer program works. With reference to a variation of 3D design files, this study examines the issue about the fair use of them and article 103 of copyright law that is concerned with the burden of ‘notice and takedown system’ of copy and transmission to implement without certain assessments whether to have copyright or not to. On this wise, the points at issue related to 3D design files will have an substantial influence on the copyright law and be in need of review for the appropriate counterplan.
