국문 초록

남북 사이의 저작권 교류는 1980년대까지 단절 되었다가 1990년대 교류가 합법 적으로 인정되었다. 저작물 교류가 증가하는 추세를 보이면서, 이에 점차 남북 저작 물은 보호의 대상이 되고 있다. 또한 남북 분단으로 인한 서로 다른 국가적 특성에 의하여 저작물 무단이용과 저작권 이용계약의 적합성 등의 문제가 나타나 불법이용에 따른 저작권 침해가 발생하고 있으며, 이러한 문제들이 저작권 교류의 활성화에 방해를 주고 있다. 따라서 합법적인 남북 저작권 교류를 가능하게 하는 남북 상호 협력방안이 요구된다. 특히 이러한 상호 협력방안은 남북 저작권사업이 현재 저작권 교류 관리 사업에서부터, 통일 이후에 법체계가 안정화될 때까지 지속적으로 저작권 관리를 담당하여야 하므로 협력방안에 대한 현실에 적합한 구체적인 논의의 필요성이 더욱 부각되고 있다. 이렇게 현실에 적합한 협력방안에 대해서 논의하기 위하여 대부분 창작자 개인 에게 귀속되는 저작권을 관리·보호하는 것을 중심으로 하는 남측의 저작권 집중관 리제도와, 창작자뿐만 아니라 창작자가 속해있는 기관에게도 귀속되는 저작권을 관리·감독하는 북측의 저작권사무국을 살펴보아야 한다. 이에 따라 양측의 체계에 모두 적합한 남북 저작물 교류에 대한 남북 단일의 구체적인 협력방안에 대하여 모색해 본다. 이렇게 살펴본 남북의 저작권 현 체제를 최대한 바꾸지 않는 선에서 남북 저작물 교류 시 발생하는 문제점을 보완할 수 있도록 남북 단일의 저작권 집중관리기구를 설립해야한다. 따라서 대리·중개의 성격을 가지고, 민간기구가 운영하는 남북 단일의 저작권 집중관리기구가 설립되어야 한다. 이러한 집중관리기구는 양국에 의해서 관리·감독 되어야 하며, 이러한 남북 단일 저작권 집중관리기구의 설립은 남북 저작물의 합법적인 이용을 이끌어 냄과 동시에 남북의 의사소통 창구로 이용되고, 통일 이후에도 법적 안정을 주는 등의 중요한 의의를 가진다.

영문 초록

Copyright exchange between south and north Korea has been cut off until 1980s, but the exchange was legally admitted in 1990s. With the increasing trend of works exchanges, works in south and north Korea become the subjects of protection. And, as the problem of illegal use of works and the issue of suitability in copyright utilization contract appeared, copyright infringement caused by illegal use occurs and these problems disrupt the vitalization of copyright exchange. Therefore, mutual cooperation plans between south and north Korea is required which enables legal copyright exchange between south and north Korea. Especially regarding these mutual cooperation plans, the necessity is more magnified to discuss the details about cooperation plans which are appropriate for current situations because copyright projects in south and north Korea should consistently manage the copyrights from current copyright exchange management projects subsequently until the legal system is stabilized after unification. In order to discuss the cooperation plans which are appropriate for current situations, intensive copyright management system of the south which focuses on managing and protecting the copyrights which are vested mostly to individual creators and copyright executive office of the north which manages and supervises the copyrights which are also vested to the institutions where the creators are affiliated as well as creators themselves should be examined. Accordingly, concrete cooperation plans of unitary organization between south and north Korea are to be sought about the works exchange between south and north Korea which are all appropriate for the systems of both sides. In a way not to change current copyright system between south and north Korea which has been identified this way, unitary intensive copyright management organization between south and north Korea should be established in order that the problems could be supplemented which occur during the works exchange between south and north Korea. Therefore, unitary intensive copyright management organization between south and north Korea should be established which is operated by the private organization with the characteristic of deputy and mediation. This intensive management organization should be operated and supervised by both countries and the establishment of unitary intensive copyright management organization between south and north Korea has an important meaning to draw the legal use of works of south and north Korea and at the same time, to be used as communication channel between south and north Korea and give legal stability after unification as well.
