국문 초록

전기통신사업법과 방송법은 각각 통신사업과 방송사업에 대해서 소유규제를 하고 있다. 이 글은 우선 통신사업과 방송사업에 적합한 소유규제가 무엇인지에 대한 해석론 및 입법론을 전개한다. 전기통신사업법의 소유규제는 외국인의 소유제한 기준, 공익성 심사의 구체적 기준과 관련해서 문제를 안고 있다. 방송법의 경우는 특정인의 소유제한, 대기업의 소유금지와 관련해서 문제를 안고 있다. 한편 통합융합시대에 부합하는 법제의 제정도 시급하다. 사업자별 접근이 아니라 기능별 접근을 통해서 규제의 형평성, 합리성, 효율성을 제고해야 한다. 통신업계와 방송업계의 협력과 예지를 기대한다.

영문 초록

The Telecommunication Act and the Broadcasting Act prescribe the ownership regulations in the area of telecommunication and broadcasting businesses respectively. This paper deals with the interpretation and reform of those provisions. It needs to be pointed out that the provisions of the Telecommunication Act regarding the limitation of the number of stocks owned by foreigners, and requirements for the assessment of public interests are open to doubt, and that this is also true of the provisions of the Broadcasting Act concerning the limitation of the number of stocks owned by a particular person, and the prohibition of the conglomerate’s ownership. On the other hand, it seems urgent to make a legislation suitable for the fusion of telecommunication and broadcasting businesses. Functional approach not but service provider approach can guarantee and enhance the fairness, reasonableness and efficiency of ownership regulation. It is hoped that the telecommunication industry and broadcasting industry will cooperate and compromise for a desirable solution.
