추급권의 국내 도입에 관한 고찰

국문 초록

여타 추급권(미술저작자의 재판매권)의 국제적, 국내적 입법화 과정과 마찬가지로 한국법체계로의 추급권 도입의 문제 역시 첨예한 논쟁을 불러일으켰다. 한-EU FTA 협상에서 EU가 추급권 도입을 제안하자, 대체로, 많은 예술가들은 찬성의 뜻을 표시하였 으나, 예술계의 유통업자들은 이에 반대하였다. 현재 동 이슈는 여전히 논의 사항으로 남아 있으며, 그 논의의 필요성은 동 FTA가 발효함에 따라 더욱 커지고 있다. 추급권의 국내 도입은 여러 측면에서의 숙고가 필요한 문제이며 이러한 숙고들은 도입 결정 이후(도입하는 것으로 결정한 경우)에도 관련법 제정에 기여할 것이다. 저작권적 측면과 국제적 조화를 고려할 때, 추급권의 국내 도입이 이루어질 확률이 높은 것으로 전망된다. 반면, 경제적 측면과 예술사회학적 측면에 있어서는 동 이슈에 관한 충분한 연구가 이루어지지 않고 있는 것으로 보인다. 추급권과 관련된 이슈들을 결정함에 있어서 관련된 다양한 측면들에 관한 심도 있는 연구 없이는 성공적인 결과를 이끌어 낼수 없으며, 그 결정에 있어서 특히 추급권이 예술가가 중심이 되는 권리라는 점을 간과하지 말아야 할 것이다.

영문 초록

As in the experiences of other international and domestic legislations around the world, legalizing droit de suite (artists’ resale royalty right) in Korea has been a controversial issue. When the EU proposed in the course of Korea-EU FTA negotiations that Korea adopt this right, many artists welcomed this proposed legislation while distributors opposed it. The issue is still pending and the need to establish Korea’s position on this issue is growing rapidly as the Agreement becomes effective. Adopting droit de suite requires comprehensive, multifaceted deliberations. These same deliberations will also contribute to the implementation of the right if it will be accepted in the Korean legal system. While it is likely that droit de suite will eventually be integrated into the Korean legal system due to the call to respect copyrights and the international trend of harmonizing legal systems, from the economic or sociological point of view it does not seem sufficient studies have been done on this issue. Gaining an accurate understanding of the art field is also an imperative, since droit de suite is an artist-centered right.
