지적학적 관점에서의 국경선에 관한 시론적 연구

국문 초록

본 연구의 목적은 특정 국가가 필지중심으로 자국의 토지경계를 관리 운영하는 것을 지적제도의 본질로 인식하고 있는 것을 탈피하여 국가와 국가 간의 경계 즉, 국경선에 관한 부분과 연계한 지적학적 이론정립을 모색하는 것이었다. 이를 통해, 기존까지 지정학 또는 국제법의 영역에서 주로 다루어졌던 국경선에 관한 주요 내용이 지적학적 관점에서는 어떻게 재해석될 수 있는지를 제시함과 더불어 그 과정에서 유의미한 학술적 이론을 정립하고자 하였다. 이와 같은 연구목적에 따라, 본 연구는 지적학적 관점에서의 국경선에 관한 함의를 다음과 같이 도출해 볼 수 있었다. 첫째, 토지경계의 관념과 국경의 관념에서는 경계의 결정 또는 획정에 따라 소유권과 영유권의 범위 및 내용이 정해진다는 공통된 특성에도 불구하고, 그와 같은 권리관계가 형성되는 절차에서는 다소의 차이가 있다. 둘째, 토지경계의 결정과정과 국경선의 획정과정에서는 각각의 목적에 두드러진 특징을 가지고 있으며, 그 방법론적으로도 우선순위로 두는 사항이 서로 다르게 나타날 수 있다. 셋째, 토지경계분쟁과 국경선분쟁에서는 분쟁을 야기하는 원인에는 서로 이질성이 있으나, 그 해결방식에 있어서는 공통적으로 소송을 통한 판결에 의존하는 경향이 크다.

영문 초록

The purpose of this study is to establish a cadastral Science theory linking the border line between the nations rather than finding out how a particular country perceives the management and operation of its own land boundaries as the essence of the intellectual system. As a result, this study presented a reinterpretation of cadastral science of the main contents of the border line, which had been mainly dealt with in the area of geopolitics or international law, and in the process, we tried to establish a meaningful academic theory. For this purpose, the implications for the border line of the point of view of cadastral science can be derived as follows. Firstly, despite the common characteristics of the idea of land boundaries and the idea of borders that the scope and content of ownership and sovereignty are determined by the decision or demarcation of boundaries, there are some differences in the procedure in which such a relationship is formed. Secondly, in the process of determining land boundaries and in the process of delimiting borders, they have prominent features for each purpose and the methodological priorities can be different. Lastly, land boundary disputes and border disputes are heterogeneous in the causes of disputes, there is a strong tendency to rely on judgements made through litigation in common.
