경찰 차량추격의 정책적 미흡에 대한 보완적 논의

국문 초록

본 연구의 목적은 효율적인 경찰 차량추격활동을 위한 정책방안 수립에 있다. 이를 위해 차량추격 활동의 적정성을 국내외 판례와 실무사례를 고찰하여 제시하였다. 구체적 정책대안은 다섯 가지로 구분할 수 있다. 첫째, 차량추격의 적정성 기준이 정립되어야 한다. 법규제정과 더불어 실무적 차원의 활동절차와 내용을 구체화하는 방안이 바람직할 것이다. 둘째, 차량추격 현황에 대한 데이터 베이스가 구축되어야 한다. 추격정보를 적극적으로 획득하기 위해서는 결과보고에 대한 별도의 기준을 신설할 필요가 있다. 전산화된 보고시스템을 활용하는 방안도 생각해 볼 수 있다. 셋째, 추격관련 교육이 전반적으로 활성화되어야 한다. 추격 상황을 대비한 전문 운전교육 프로그램이 개발되고 이를 위해 물리적 교육환경 조성도 요망된다. 넷째, 장비관리 차원의 법규가 정비되어야 한다. 경찰장비사용규정에 차량추격관련 내용을 보강하는 방안을 검토해 볼 수 있다. 다섯째, 업무특성을 고려하여 고속도로순찰대를 위한 추격정책이 별도로 마련되어야 한다. 폭주족 단속의 효율성 확보차원의 정책수립 방안도 검토되어한다. 안정적 추격을 위한 장비의 보강도 중요한 문제이다. 재량으로만 미뤄두기에 차량추격은 무척이나 위험한 활동이라 할 수 있다. 그러므로 차량추격 자체가 유명무실하고 소극적인 경찰활동으로 낙인될 우려도 있다. 차제에 경찰의 차량추격에 대한 실질적인 정책입안이 이루어지게 되기를 기대해 본다. 경찰과 시민 모두를 위한 바램이다.

영문 초록

Police s ultimate object is suppression. The police must observe law on the accomplishment process. If violate law, it is no any use or responsibility can be given to police officer. Police s vehicles pursuit is activity for arrest. It is legal action that will suppress. If simple threats and dismiss are objective, we can not speak as pursuit. It is differentiated with exercise authority. Therefore, Police Officer must do best for lawful activity at vehicles pursuit. Moreover, vehicles pursuit is dangerous force more than deadly weapon use. Vehicles pursuit need more attentions cause of citizense s damage potentialities. Therefore, standard of propriety should be readied in whole process of pursuit that need policy support about external situation. By the way, South Korea police had a little policy examination about vehicles pursuit. This field is a important theme of police science. Therefore, this research want to move the policy about police vehicles pursuit through precedent. First, vehicles pursuit law should be revised. Second, It must examine entire revision of vehicles pursuit manual. Manual should be decided concretely about Illegality exclusion and legality activity and need detailed analysis about abroad police s pursuit policy. Third, information of vehicles pursuit should be accumulated. There is need to establish newly special standard for report to acquire pursuit information actively. Computed report system is desirable. But, it must avoid that report itself is a heavy burden. Fourth, it is contents about pursuit education. Driving techniques is very basic and central item in pursuit activity. Physical investment for infra construction of driving education is fancied. Lastly, priority pursuit policy support about highway patrol and specific plan of violence drivers pursuit should be established.
