국문 초록

2010년 10월에 지방행정체제 개편에 관한 특별법이 제정되었다. 지방행정체제개편특별법은 분야별로 기본적인 개편의 방향을 제시하고 있는데 지방 행정체제개편의 기본방향으로 주민의 편익증진, 국가 및 지방의 경쟁력 강화를 위하여 ① 지방자치 및 지방행정계층을 적정화하고, ② 주민생활 편익증진을 위하여 자치구역을 조정하며, ③ 지방자치단체의 규모와 자치역량에 부합하는 역할과 기능을 부여하 고, ④ 주거단위의 근린자치를 활성화한다는 것을 개편방안에 반영하도록 하고 있다. 지방행정체제개편특별법에서는 행정체제개편과 관련된 주요 6개 과제를 제시했는 데, ① 특별시․광역시 개편, ② 도의 지위․기능 재정립, ③ 시․군․구 개편, ④ 읍면․동 주민자치, ⑤ 통합 지방자치단체․대도시에 대한 특례, ⑥ 지방분권의 강화 등이다. 동법 제15조에 따르면, 시․군․구의 경우 인구, 지리적 여건, 생활권․경제권, 발전가능성, 지역 특수성, 역사적․문화적 동질성 등을 종합적으로 고려해 통합이 필요한 지역을 지원하도록 하였다. 지방행정체제개편특별법은 지방행정체제 개편의 추진기구와 절차, 통합기준과 범위, 국가차원의 지원 등을 포괄적으로 담고 있는데 특히 주목할 점은 국회의 지방행정체제 개편과정에서 큰 쟁점이 되었던 지방자치의 중층제에서 단층제로의 계층축소는 직접 적으로 규정하지 않았다는 것이다. 즉, 지방행정체제개편특별법은 도의 지위를 지방자 치단체로서 유지하도록 명시하고 있는 것이다. 지방행정체제개편특별법은 지방자치단체의 통합에 관한 특별법이라기보다는 통합절 차에 관한 특례를 규정한 지방자치단체통합에 관한 특례법의 성격을 가지는 법률로 보아도 무방하다고 생각한다.

영문 초록

The Special Law for the Reform of the Local Administrative System was legislated October 2010. The Special Law for the Reform of the Local Administrative System suggests the orientation of basic reform by sector as follows: ① To properly classify layers of local self-government and local administration ② To adjust self-governing zones for the improvement of residential life benefits ③ To endow with roles and functions suitable for the size and autonomous capacity of local autonomous entity ④ To activate neighboring self-government of residential units. These basic orientations are intended to reflect on the reform methods to improve residential life benefits and competitive power enforcement of the national and local government. 6 tasks related with the reform of administrative system are suggested in the Special Law for the Reform of the Local Administrative System as follows: ① Reform of special city or metropolitan city ② Re-establishment of position and function of the Province (Do) ③ Reform of City, Gun and Gu ④ Residential self-government in Eup, Myeon or Dong units ⑤ Special Special administrative and financial incentives for integrated local entities and large cities ⑥ Enforcement of local decentralization. According to Article 15 of the same Law, City, Gun and Gu shall support the zones where integration is needed generally considering population, geological conditions, life and economy spheres, prospect of development, local specialty and historical or cultural homogeneity, etc. The Special Law for the Reform of the Local Administrative System comprehensively contains promotion organizations and procedures of reform of local administrative system, criteria and scopes of integration, and support, etc in the level of a nation. Especially noticeable point, that became a large issue in course of the Special Law for the Reform of the Local Administrative System by the National Assembly, is that layer reduction from the doubled layering system to the singly layer system of self-government was not directly specified. In other words, the Special Law for the Reform of the Local Administrative System specifies to maintain the position of Do as a local autonomous entity.
