국문 초록

본 논문은 최근에 나타난 미국의 수입식품 안전관리제도의 변화를 분석하고 동 시스템에 대한 평가로서 미국의 식품안전관리체제가 글로벌 이니셔티브로 작용하기 위한 조건을 연구하고 이를 위한 제언을 행한 연구이다. 변화된 미국의 수입식품안전관리시스템은 분야별 규제기관을 중심으로 한 포괄적 관리와 예방적 안전관리체제라는 특징을 가지고 있다. 미국의 수입식품안 전관리체제에 가장 큰 영향을 미치는 핵심 법률 환경으로는 식품안전현대화법(FSMA), 바이오 테러리즘법(Bioterrorism Act), 연방수입우유법(FIMA)을 들 수 있다. 미국의 수입식품에 대한 안전관리에 영향을 미치는 절차적 요건으로 사전시설등록제와 사전신고제, FDA 통관절차, 해외식품시설에 대한 FDA의 검정을 들 수 있고, 실체적 요건으로는 수입업자의 강화된 책임, 위해성 평가를 근거로 하는 안전통제조치, 위해물질 및 식품첨가제에 대한 관리 등을 들수 있다. 본고에서는 이러한 분석을 바탕으로 변화된 미국의 수입식품안전관리제도가 기존 제도에 비해 가지고 있는 3가지 장점을 도출하였다. 그리고 이러한 제도적 선진성이 발현되어 식품안전 관리분야의 글로벌 이니셔티브로서 작용할 수 있는 가능성을 분석하고 이를 위한 2가지 정책제언을 하였다.

영문 초록

This paper study on analysis of the food safety control system made in the US. And this study evaluate the probability of global initiative in the part of food safety control system and make some proposals. The US s food safety control systems recently changed has two characteristics that is comprehensive control through relevant agencies and preemptive introduction of preventive system for the food safety. And this stydy analysis main legal circumstance for imported food as FSMA, Bioterrorism Act, FIMA. This paper analyze the registration of food facility and prior notice, the FDA custom procedures, and FDA’s inspection of foreign food facility as main procedural requirements related to the safety control for the imported food in the US. And in substantive requirements of the US s food safety control systems are strengthening of responsibilities of Food Importer, safety controls based on a hazard assessment, and hazardous materials and food additives. Based on this analysis, this paper evaluates three advantage of preventive food safety control systems newly established in the US. Also in order to serve the US’s food safety control system as global initiative in the food risk control system, this study make two alternatives.
