국문 초록

Gard Marine & Energy Ltd. v. China National Chartering Co. Ltd.(The Ocean Victory) 사건의 주요한 쟁점은 정기용선자의 안전항 배선의무위반이 본선의 전손을 초래한 것인지에 대해 고등법원은 일본 카고시마항이 비안전항이 아니라고 판시하였다. 여기서는 선주에게 구상사슬이 연결될 수 있는지를 판단할 경우 보험증권만을 보면 되는 것인지 또는 선체용선계 약의 의도도 고려해야 할지가 문제로 된다. 선체용선자의 의도를 고려해야 한다면 그 의도는 무엇인지, 보험증권상 피보험자의 의미 등 의외로 많은 요소의 검토가 필요하게 된다. 즉, 이사건에서는 피보험자로서 기명된 선체용선자에 대한 보험금의 대위구상이 가능한지의 여부가 쟁점이 된 사안이다. 본 연구에서는 영국 고등법원 판결의 부수적 의견으로서 설명한 안전항 배선의무위반이 있게 된 경우 선주, 선체용선자, 정기용선자간의 구상사슬로 연결될 수 있는 지를 중심으로 분석한다. 이를 통한 연구결과는 이들 문제와 관련된 사례가 발생할 경우 하나의 기초자료로서 활용할 수 있을 것이다.

영문 초록

This study analyse the Ocean Victory case focused on the three issues. There were three principal issues arising on the appeal, namely: 1) whether as a matter of law in the circumstances there had been a breach of the safe port warranty (“the safe port issue”), 2) whether, even on the assumption that there had been a breach of the safe port warranty, the cause of the casualty was not the breach, but rather the Master’s navigational decision to put to sea in extreme conditions, rather than to stay at the berth (“the causation issue”); and 3) whether, on the true construction of the terms of the demise charter party, the demise charterers, who had insured the vessel at their expense, had any liability to the owners in respect of insured losses, notwithstanding that such losses may have been caused by a breach of the safe port warranty (“the recoverability issue”).
