독일의 보험사기방지에 대한 입법적 대책과 우리의 보험사기방지특별법

국문 초록

보험사기와 보험범죄가 시간이 지날수록 그 형태가 다양해지는 동시에 조직적이면서도 지능화 되어 가고 있는 양상이다. 보험사기의 증가는 보험회사의 경영 악화를 야기한다. 보험금 지급의 누수는 다수의 선량한 보험계약자의 보험료 인상이라는 결과를 초래한다. 보험사기를 예방할 수 있는 실정법이 존재하지 않는 것은 아니다. 그러나 각각의 법률에 규정되어 있는 예방책은 보험사기를 방지하고자 함에 있어 한계가 발생하고 있는 실정이다. 실정법의 불비를 보완하기 위하여 개별법에 보험사기를 담는 방법, 형법에 담는 방법, 보험업법에 담는 방법 또는 산재되어 있는 보험사기의 규정을 통일적으로 정비하기 위하여 특별법을 제정하는 방안 등이 제시되었다. 보험사기를 예방하기 위하여 각국은 다각적인 노력을 하고 있다. 2016년 3월 3일 보험사기방지특별법이 국회를 통과하였다. 보험계약법에서 보험사기를 예방하고자 하는 방안이 무산된 반면에 특별법으로 보험사기를 근절하고자 하는 방안을 통하여 악의적인 보험사기를 근절하고자 하는 방안이 채택된 것이다. 본 논문은 보험사기를 위방하기 위한 독일의 입법적 논의를 전개하고 있다. 독일 보험계약법은 사기로 인한 계약의 경우 보험자가 취소할 수 있는 권리를 인정하고 있다. 이에 대한 내용을 살펴보는 동시에 형법상 인정되고 있는 보험남용죄와 보험사고의 예비사기죄에 대한 내용을 고찰한다. 또한 금번 제정된 보험사기방지특별법의 주요 내용들을 살펴보는 동시에 법적 쟁점을 검토한다.

영문 초록

The form of insurance fraud and insurance crime are a little bit more diversifying, organizing and intelligent. Increases of insurance fraud cause financial difficulty of an insurance company. Leaking to payment of insurance bring about premium growth of a great number of innocent policyholders. There are some positive Acts to prevent insurance fraud. However, insurance fraud occurs continuous despite of measures taken in advance to prevent something dangerous, unpleasant, or inconvenient from insurance fraud. There are criminal law or the insurance business act and enact special law as suggestions to be suggested and improve the problem of insurance fraud by positive law, but it is not effective as solutions to problems. This paper addresses Prevention of Insurance Fraud in contract law and criminal Law in Germany and legislation prosess, main contents of Special Act on Prevention of insurance fraud in Korea. This Act consists of a total of 16 provisions and its purpose is to punish insurance fraud investigation and to prevent insurance fraud from diversifying, organizing. In case of the suspicion of insurance fraud, insurance company has to inform to the Financial Services Commission(FSC). The FSC can charge or investigate to the investigation. Some penalties to prevent insurance fraud is also provided in the Special act. The Special Act on Prevention of insurance fraud for preventing insurance fraud is expected to play a large role in reducing insurance fraud.
