국문 초록

1997년 12월 17일, OECD 28개 회원국과 4개의 옵저버국가(아르헨티나, 불가리 아, 칠레, 슬로바키아, 브라질)은 국제상거래에서 외국 공무원의 뇌물수수를 금지하는 협약(Convention on Combating Bribery of Foreign Public Officials in International Business Transactions)을 체결하고, 협약이행을 위한 법적절차를 도입하는데 합의하였다. 1999년 5월 25일, OECD 뇌물방지협약을 인정한 프랑스 국내법이 채택되었다. 2000년 7월 31일 OECD 뇌물방지협약의 이행을 위한 절차가 프랑스에서 공표되었다. OECD 뇌물방지협약의 회원국으로 프랑스는 협약을 비준하고 국내법적 절차를 도입 하면서 협약체결국으로 의무사항을 준수하고 있다. 그러나, 다른 국가에 비해서, 프랑스의 거버넌스는 투명성에 문제가 있다. 이에 대한 사례로 프랑스 기업이 연루된 각종 뇌물사건을 들 수 있다. 프랑스의 거버넌스 투명성 문제의 근원은 반-부패관련 법적조치가 프랑스에서 잘 갖추어지지 못했기 때문이 아니 라, 프랑스의 엘리트층의 거버넌스가 폐쇄성을 갖고 있기 때문이다. 소수정예의 폐쇄적 인 그랑제콜 시스템에 근거한 프랑스 엘리트층은 엘리트층 내부에서 발생하는 부패문제를 감독하는데 효율성이 떨어질 수 밖에 없다. 따라서, 프랑스에서 반부패 환경을 확산시키기 위해서는 프랑스 정치, 경제, 사회 거버넌스의 개선이 반-부패 관련 법률제도 도입보다 훨씬 더 중요한 사안이라고 볼 수 있다.

영문 초록

On December 17, 1997, 28 OECD member-states and 4 observer countries (Argentina, Bulgaria, Chile, Slovakia, Brazil) signed a Convention on Combating Bribery of Foreign Public Officials in International Business Transactions and agreed to introduce the inspection measure for this Convention. On May 25, 1999, the Frech National law, which recognize the OECD anti-Bribery convention, was adopted. On July 31, 2000, the measures for the execution of this OECD convention was proclaimed. As a member-states of the OECD Anti-bribery Convention, France is respecting its obligation in ratifying this Convention and introducing the national regulations for it. However, compared to other countries, France has a problem of transparency of governance. We can find these examples from the Bribery cases in which French companies are involved. The reason of French problem of transparency is not originated from the lack of Anti-corruption measures but from the closed French Elite circle’s governance. Based on Grandes Ecoles system, French Elite Circle harms the corruption inspection between French Elite circle members. Therefore, in order to improve the Anti-bribery environment in France, the improvement of French Politic, Economic and Social governance is much more important than the introduction of legal measures for the Anti-corruption.
