공공데이터로서의 지적데이터 제공에 관한 법적 검토

국문 초록

본 연구의 목적은 지적 분야에서 공공기관이 보유하고 있는 지적데이터를 제공하는 데 따르는 세 가지 주요 쟁점, 즉 (1) 지적데이터의 제공 범위와 내용을 어떻게 정할 것인지 여부, (2) 그 제공의 대가를 유상 또는 무상으로 할 것인지 여부, (3) 측량 수로조사 및 지적에 관한 법률 상의 지적전산자료 이활용 사전 승인 규정이 공공데이터의 제공 및 이용 활성화에 관한 법률 의 근본 목적과 상충되는지 여부를 검토하여 향후 관리방향을 제시함으로써 합리적이고 효율적인 지적데이터의 제공 및 이 활용을 도모하는 데 목적이 있다. 검토 결과, (1) 일반적인 지적데이터의 대부분을 제공대상으로 목록화하여 등록하되, 지적(임야)도형데이터의 경우에는 도해지적을 분리하여 부분 제공하고, 특히 지적측량성과데이터의 경우에는 그 기술적인 분리 자체가 곤란하여 비제공 대상으로 분류하는 것이 타당한 것으로 판단하였다. (2) 제공의 대가는 정부정책에 부합하도록 무상제공을 원칙으로 하는 것이 바람직하다고 판단하였다. (3) 측량 수로조사 및 지적에 관한 법률 상의 지적전산자료 이 활용 사전 승인 규정은 공공데이터법의 근본 목적에 부합되도록 간편한 신청 규정으로 개정될 필요가 있다고 판단하였다.

영문 초록

The purpose of this paper is to promote the reasonable and effective distribution of cadastral data by critically reviewing three issues in relation to providing cadastral data to the public. The first issue is to decide the contents and ranges of cadastral data distribution, the second issue is to determine whether the services need to be free or paid, and the final one is to check whether the prior approval regulation involving the use of the computerized cadastral data in Land, Waterway Survey and Cadastre Law is at odds with Law of Public Data Provision and Promotion of the Use. The review of the three issues has come into conclusion that (ⅰ) most of cadastral data need to be categorized, land cadastre should be separated from sea cadastre in providing their data, and the data of cadastre survey achievement do not need to be in the category of data distribution; (ⅱ) it is advisable that the data services should be free to meet the government policies; and (ⅲ) the prior approval regulation involving the use of the computerized cadastral data in Land Waterway Survey and Cadastre Law is supposed to be simplified to fit the fundamental purpose of the public data law.
